Bradley Morales to be sentenced for murder on Sept. 28, objects to pre-sentence investigation

Bradley Joe Morales, 28, scheduled to be sentenced Sept. 28 for the murder of his ex-girlfriend, Sharmaine Leake, asked for a new trial and is objecting to a pre-sentence investigation.

Morales filed a motion June 5 saying he should get a new trial because he didn’t think the state proved beyond a reasonable doubt that he exhibited “extreme indifference to human life” when he stabbed the mother of his three children to death. At trial, Morales’ lawyer, Steven Mottinger, had argued that Morales stabbed the woman accidentally during a dispute and that he afterwards rendered aid and begged others to save the woman. Ward County State’s Attorney Roza Larson said in her response that the court does not have authority to order a new trial under state law because a jury found Morales guilty.

Morales also claims in another motion that many facts in a pre-trial investigation are incorrect. Morales notes in his motion that he was under juvenile court supervision as a teenager from ages 13 to 18 and the investigator didn’t contact people who knew him at that time or his family members. Judge Doug Mattson has issued an order that the PSI investigator attend the sentencing hearing.

Morales was convicted of Class AA felony murder and faces up to life in prison without parole.
