Slade Herfindahl, Tioga, sentenced for posting intimate images of ex-girlfriend on her employer’s Facebook page

Slade Vernon Herfindahl, 44, Tioga, was sentenced on Tuesday to 360 days in jail, with a requirement that he serve 180 days, and two years of supervised probation for posting sexually explicit images of his ex-girlfriend on her employer’s Facebook page and texting the images to her supervisor last year.

Herfindahl pleaded guilty on March 19 to Class A misdemeanor distribution of intimate images without consent and Class B misdemeanor harassment. At the change of plea hearing, he told the judge he was blackout drunk at the time and didn’t remember posting the images. He told Judge Stacy Louser he must have been angry at the time.

Herfindahl took pictures of the woman and they made videos of themselves having sex during their relationship, but the woman told Herfindahl to delete them and never gave him permission to distribute those images.

Louser told Herfindahl at the sentencing hearing on Tuesday that the damage he did to the woman’s sense of personal privacy and the potential impact his actions had on her employment cannot be undone. She said his actions were calculated, intended to humiliate and embarrass the woman, and are against the norms and expectations of decency.

Herfindahl has also been ordered to have no contact with the victim and to pay court costs. He will not be required to register as a sex offender.

In another case, Herfindahl pleaded guilty on June 25 in district court in Williston to Class C felony DUI, a charge dating back to July 3, 2018, and to Class B misdemeanor simple assault, a charge dating back to July 29, 2018. He was sentenced to three years in jail on the DUI charge, with a requirement that he serve one year and one day, and two years of supervised probation. For the domestic violence charge, he was sentenced to 30 days in jail, concurrent with the sentence on the DUI charge. According to court documents, Herfindahl struck a 7-year-old boy in the face at his residence in Tioga on July 29, 2018, and left a bruise on the child’s face. Herfindahl is also ordered to participate in the 24/7 Sobriety Program and obtain a chemical dependency evaluation.

Louser told Herfindahl on Tuesday that she is aware of the facts of that case and is “concerned that you are on a path of spiraling somewhat quickly out of control.”

Herfindahl’s lawyer, Ashley Gulke, told Judge Stacy Louser in March that Herfindahl has been receiving treatment for alcohol addiction and mental health problems.

In the Ward County cases, Herfindahl will receive credit for 120 days served in jail. More investigation will be required to determine whether he is entitled to time served for time spent in a treatment facility.
