Each bid shall be accompanied by a

separate envelope containing a Bid

Bond in a sum equal to five percent

(5%) of the maximum bid price, exe-

cuted by the Bidder as principal and

by a surety company authorized to

do business in the State of North

Dakota, payable to the Devils Lake

Regional Airport Authority, condi-

tioned that if the principal’s bid be

accepted and the contract awarded

to him, he, within ten (10) days after

Notice of Award has been executed,

will execute and effect a contract in

accordance with the terms of his bid

and a contractor’s bond as required

by law and regulations and determi-

nations of the governing board. The

bid security of the two lowest

bidders will be retained until the No-

tice of Award has been executed,

but no longer than one hundred and

twenty (120) days. The bid security

is a guarantee that the bidder will

enter into contract for work

described in the Proposal.

The Contractor shall also enclose

within the Bid Bond envelope a copy

of the bidder’s North Dakota Con-

tractor’s License or a copy of their

latest renewal certificate issued by

the Secretary of State as per North

Dakota Century Code 43-07-07 and

43-07-12. Any bid not containing this

document shall not be acceptable

and shall be returned to the Bidder.

The successful Bidder will be

required to furnish a Contract

Performance Bond and Payment

Bond in the full amount of the

Contract.

The Devils Lake Regional Airport,

Devils Lake, North Dakota, reserves

the right to hold all bids for a period

of ninety (90) days after the date

fixed for the opening thereof to reject

any and all bids and waive defects

and to accept any bids should it be

deemed for the public good and also

reserves the right to reject the bid of

any party who has been delinquent

or unfaithful in the performance of

any former contract to the Owner.

The successful Bidder will have to

obtain a statement from the Office of

the State Tax Commissioner show-

ing that all taxes due and owing to

the State of North Dakota have paid

before the contract can be executed.

NOTICE OF REQUIREMENT FOR

AFFIRMATIVE ACTION TO

ENSURE EQUAL EMPLOYMENT

OPPORTUNITY

1. The Offeror’s or Bidder’s attention

is called to the “Equal Opportunity

Clause” and the “Standard Federal

Equal

Employment Opportunity Construc-

tion Contract Specifications” set

forth herein.

2. The goals and timetables for

minority and female participation,

expressed in percentage terms for

the Contractor’s

aggregate workforce in each trade

on all construction work in the

covered area, are as follows:

Timetables

Goals for minority participation for

each trade: 2.0%

Goals for female participation in

each trade: 6.9%

These goals are applicable to all of

the Contractor’s construction work

(whether or not it is Federal or

federally assisted) performed in the

covered area. If the Contractor per-

forms construction work in a geo-

graphical area located outside of the

covered area, it shall apply the goals

established for such geographical

area where the work is actually per-

formed. With regard to this second

area, the Contractor also is subject

to the goals for both its federally in-

volved and non-federally involved

construction.

The Contractor’s compliance with

the Executive Order and the regula-

tions in 41 CFR Part 60-4 shall be

based on its implementation of the

Equal Opportunity Clause, specific

affirmative action obligations re-

quired by the specifications set forth

in 41 CFR 60-4.3(a) and its efforts to

meet the goals. The hours of minori-

ty and female employment and train-

ing must be substantially uniform

throughout the length of the contract,

and in each trade, and the Contrac-

tor shall make a good faith effort to

employ minorities and women even-

ly on each of its projects.

The transfer of minority or female

employees or trainees from Contrac-

tor to Contractor or from project to

project for the sole purpose of meet-

ing the Contractor’s goals shall be a

violation of the contract, the Execu-

tive Order and the regulations in 41

CFR Part 60-4. Compliance with the

goals will be measured against the

total work hours performed.

3. The Contractor shall provide writ-

ten notification to the Director of the

Office of Federal Contract Compli-

ance Programs (OFCCP) within 10

working days of award of any con-

struction subcontract in excess of

$10,000 at any tier for construction

work under the contract resulting

from this solicitation. The notification

shall list the name, address, and

telephone number of the subcon-

tractor; employer identification

number of the subcontractor;

estimated dollar amount of the sub-

contract; estimated starting and

completion dates of the subcontract;

and the geographical area in which

the subcontract is to be performed.

4. As used in this notice and in the

contract resulting from this solicita-

tion, the “covered area” is North

Dakota, Ramsey County, Devils

Lake.

The Devils Lake Regional Airport, in

accordance with the provisions of Ti-

tle VI of the Civil Rights Act of 1964

(78 Stat. 252, 42 U.S.C. 2000d to

2000d-4) and the Regulations, here-

by notifies all bidders or offerors that

it will affirmatively ensure that

any contract entered into pursuant to

this advertisement, disadvantaged

business enterprises will be afforded

full and fair

opportunity to submit bids in

response to this invitation and will

not be discriminated against on the

grounds of race, color,

or national origin in consideration for

an award.

The requirements of 49 CFR part 26

apply to this contract. It is the policy

of the Devils Lake Regional Airport

to practice

nondiscrimination based on race,

color, sex, or national origin in the

award or performance of this con-

tract. The Owner

encourages participation by all firms

qualifying under this solicitation re-

gardless of business size or owner-

ship.

The Owner’s award of this contract

is conditioned upon Bidder or Of-

feror satisfying the good faith effort

requirements of 49

CFR Å’26.53. As a condition of bid

responsiveness, the Bidder or Of-

feror must submit the following infor-

mation with their

proposal on the forms provided

herein:

1. The names and addresses of

Disadvantaged Business Enterprise

(DBE) firms that will participate in

the contract;

2. A description of the work that

each DBE firm will perform;

3. The dollar amount of the partici-

pation of each DBE firm listed under

item 1;

4. Written statement from Bidder or

Offeror that attests their commitment

to use the DBE firm(s) listed under

item 1

to meet the Owner’s project goal;

and

5. If Bidder or Offeror cannot meet

the advertised project DBE goal, evi-

dence of good faith efforts undertak-

en by the

Bidder or Offeror as described in ap-

pendix A to 49 CFR Part 26.

BOARD MEETING WEDNESDAY,

JANUARY 19, 2022

Board president Nicole Wald called

meeting to order at 5:00 pm.

Members present Jenny Johns,

Stephanie Munos, Daniel Tyler,

Sara Vannatta and Nicole Wald.

Also, present Superintendent Gerd-

ing, Principal Hansen and Business

Manager Twila Gantzer. Minutes:

M/S/C Tyler/Wald to approve the

minutes from the December 8th.

Roll call vote, all voted yes. Chris

Jenner-Senior Class President: Mr

Jenner addressed the board regard-

ing their senior class trip to Seattle

over spring break. Planning to leave

March 17th and returning March

21st. Travel will be on Amtrak with

3 chaperones. They plan to use

public transportation and visit many

local attractions. The cost for the

trip is $12,500. The second option

is a trip to Billings, MT which is an

8-hour bus ride. Mrs Richard

presented notes as one of the senior

class advisors. The board would

like to see the class vote by private

ballot and present the information at

a board meeting along with a budget

and a list of chaperones. Superin-

tendent: Health & Safety Smart

Restart Plan: The plan needs board

approval every six months. There

have been no changes to the plan.

M/S/C Johns/Tyler to approve the

Health & Safety Smart Restart Plan.

Mrs Wald thanked everyone for all

the hard work they have done and

stepping up to help. Bus Grant: Our

school did receive a grant covering

25% toward the purchase of a new

bus. We could possibly receive a

federal bus grant for $20,000 toward

a new/newer bus. We do have the

funds in the budget to purchase a

bus. Our current bus fleet consists

of: #2 & #4-route buses; #7- activity

bus & back up bus for the route; #1

activity bus; Nedrose bus-a backup

bus; #3 & #6-need to be disposed

of; #5-no longer in service; 2 mini

buses-used for activities. M/S/C

Johns/Tyler to purchase a 2020-71

passenger bus using the ND state

grant. Roll call vote, all voted yes.

Fitness Equipment: Mr Hultz is

working with the YMCA to purchase

industrial cardio equipment. Busi-

ness Manager’s Report: The finan-

cial reports were presented. M/S/C

reports as presented and approve

payment of December payroll &

benefits in the amount of $

394,882.01; December board bills:

Principal: Teacher Retirement: Mrs

Hansen shared a letter from Mr

Askvig with his intent to retire at the

end of the 21-22 school year. M/S/C

Johns/Tyler to reluctantly approve

Mr Askvig’s retirement letter. Mrs

Hansen thanked all of the staff for

helping where needed with several

staff members out. Mrs Munos &

Ms Johns also thanked the staff for

helping as well. Unfinished Busi-

ness: Attendance/Absence Policy:

The change is under maximum ab-

sences changing the word “will” to

“may”. M/S/C Tyler/Johns to make

the wording change removing will

and replacing with with may. Mr

Gerding would like to review the en-

tire policy and simplify it over the

summer. School Vision Committee:

Did not meet in January. Looking to

meet after the sickness slows down.

Cultural Improvement Committee:

Did not meet in January. Mr Tyler

said the committee has put together

a great survey for the staff. Business

Manager Evaluation: M/S/C Tyler

Vannatta to approve the evaluation.

New Business: Negotiating Com-

mittee: The Surrey Teachers Associ-

ation has agreed to open negotia-

tions. Mr Tyler & Mrs Wald have

agreed to sit on the committee

representing the board. M/S/C

Johns/Vannatta to nominate Mr

Tyler & Mrs Wald to represent the

board. Executive Session: An exe-

cutive session is not necessary. The

next regular board meeting will be

Wednesday, February 9th at 5:00
