NOTICE IS HEREBY GIVEN that

the City of Minot (Owner) is request-

ing Bids for the construction of the

following Project: 2022 Traffic Signal

Improvement.

Bids for the construction of the Pro-

ject will be received at the office of

the City Clerk located at 515 Second

Avenue SW (Second Floor), Minot,

North Dakota 58701, until Tuesday,

January 11, 2022 at 11:00 AM local

time. At that time the Bids received

will be publicly opened and read.

The Project includes the following

Work: New traffic signal cabinet,

poles, mast arms, streetlights, signal

heads, pedestrian push buttons, em-

ergency vehicle preemption, pig-

mented imprinted concrete, and oth-

er related items.

Each bid must be accompanied by a

separate envelope containing the

bid security in a sum equal to five

percent of the full amount of the bid

and must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the bid and the bid bond,

and any condition of the City of

Minot, as required by law. A counter-

signature of a bid bond is not re-

quired. If the City of Minot elects to

award a contract to the lowest

responsible bidder, and the lowest

responsible bidder does not execute

a contract within the ten days al-

lowed, the bidder’s bond must be

forfeited to the City of Minot and the

project awarded to the next lowest

responsible bidder.

Each bidder must possess a valid

North Dakota contractor’s license for

the full amount of their bid, as re-

quired by Section 43-07-07 of the

North Dakota Century Code. Each

bidder MUST enclose a copy of their

Contractor’s License or Certificate of

Renewal, issued by the North Dako-

ta Secretary of State, in their bid

bond envelope, and each license

must be valid and dated at least 10

days prior to the date set for bid

opening, as required under Section

43-07-12 of the North Dakota Centu-

ry Code.

No bid may be read or considered if

it does not fully comply with the re-

quirements of Section 48-01.2-05 of

the North Dakota Century Code, and

any deficient bid submitted will be

resealed and returned to the bidder

immediately.

All Bids submitted and all Work

completed must be as stipulated in

the Agreement.

The City of Minot reserves the right

to hold all Bids for a period of 30

days after the date of the bid open-

ing, to reject any or all Bids and to

rebid the project until a satisfactory

bid is received, and to waive any in-

formality or irregularity in any Bid.

Board Meeting

November 8, 2021

The regular meeting of the Lewis

and Clark School Board was called

to order at 7:02 pm in the Berthold

School gymnasium. Board members

present were Erickson, Pank,

Brown, Deaver, Schilla, Lauten-

schlager and Schepp. Also present

were Superintendent Ritteman, Prin-

cipal Gerding, Principal Jenkins,

Principal Hochhalter, AD Eric Knut-

son, AD Rudolph and Business

Manager Lindahl.

53 guests were present. A sign in

sheet was provided for all guests to

enter names.

Motion was made by Deaver/Schilla

to approve the agenda with an addi-

tion by Erickson to add two speak-

ers. All yes. MC.

President Erickson read the ground

rules for speakers and guests.

The School Board item 11a (Volley-

ball Discussion) was moved to the

beginning of the meeting with the

added speakers starting the discus-

sion.

Speaker #1 was Adam Lee of Plaza,

ND. Topic was regarding the co-op

of sports – does not want to see full

co-op of all sports nor complete

separation. Spoke about participa-

tion numbers and being competitive.

He would like a 3rd option with foot-

ball in Berthold; basketball and vol-

leyball separate; and baseball, track

and softball kept as they currently

are. Questions were asked by

school board members and discus-

sion held with Mr. Lee.

Speaker #2 was Candice Asmund-

son of Berthold, ND. Topic was re-

garding the co-op of sports – shared

information on when the schools

came together as 1 district 18 years

ago and how a dissolution is not le-

gal. Would like to move on from this

argument. Stated the AD’s and ad-

ministration make decisions on pro-

grams and parents can decide from

there if they want their kids to partici-

pate. No questions from the school

board members.

Discussion was held on survey

results from 2 surveys. The first sur-

vey was regarding volleyball and the

second survey was regarding the

sports co-op. In regards to the vol-

leyball survey, a majority of the

votes were to separate volleyball so

each school has their own team.

In regards to the sports co-op sur-

vey, 80% of the people want to dis-

solve the current sports co-op.

Superintendent Ritteman spoke on

survey results addressing the two

options on the survey, sports philo-

sophy, and participation numbers.

His recommendation is to split the

sports co-op as that is the best op-

tion looking down the road, but will

support whatever decision the

school board makes. Lauten-

schlager spoke on the history of the

district and the reasons the schools

became one district. At the time,

2021 had low enrollment numbers

and financial struggles. The schools

came together to ensure there was

still a district. The school board at

that time tried to have 1 mascot and

1 united district, but was then sued

all the way to the Supreme Court.

Discussion continued looking at

sports participation numbers; unity;

why co-op with other schools in

sports where our district would have

enough numbers if we were togeth-

er; NDHSAA’s awareness of this

discussion; and the fact that it is not

legal to split the district organization.

Schilla had a pros and cons list he

shared regarding the sports co-op.

Deaver spoke on the results of the

survey with specifically 80% wanting

to split the sports co-op. Motion

made by Deaver/Schepp to split all

athletic co-ops within the Lewis &

Clark School district. Discussion

was held. Lautenschlager does not

see what this decision will solve. Er-

ickson replied that this issue can’t

keep coming back year after year.

On roll call vote: Schepp – Yes; Pank

– Yes; Deaver – Yes; Erickson – Yes;

Brown – No; Schilla – No; Lauten-

schlager – No. Motion carried 4-3.

Break taken at 8:10 p.m. Recon-

vened at 8:24 p.m. in the board

room.

tober 11, 2021 regular board meet-

Motion was made by Pank/Deaver

Superintendent Ritteman received a

signed contract for an additional

counselor. This position will be

100% time at the NSP school. Mo-

tion by Deaver/Pank to hire Melissa

Ryan for Lewis and Clark-NSP

Counselor for 2022-23. All yes. MC.

Superintendent Ritteman discussed

out of district bus stops. There will

no longer be funding for these miles.

The plan is to eliminate 2 extra stops

at Parshall and

New Town.

Discussion held on the changes.

These changes will go into effect on

November 29, 2021 and will affect

15 out of district students.

Superintendent Ritteman discussed

the school food delivery issue.

CashWa Distributing is no longer

servicing schools statewide. Howev-

er, they have decided to continue to

deliver to both North Shore Plaza

and Berthold schools for the rest of

this year.

Superintendent Ritteman addressed

the Attorney General open records

request. An email was sent from

Ritteman to the AG’s office question-

ing the confidentiality of the petition

as this is not believed to be a part of

the “working papers” as noted on the

ND State Auditors website. The At-

torney Generals recommendation to

this inquiry is to go through state

representatives. Once the petition is

turned in to the State Auditors Office

by the petitioners, the school district

will receive an engagement letter. At

that time the school district can sub-

mit an open records request to ex-

amine the petition. The petition can

be circulated for 180 days prior to

submitting it to the State Auditors of-

fice, so a timeframe of when an en-

gagement letter will be received is

unknown.

Ritteman pointed out that the school

district has an audit completed every

year which is in compliance with the

law that states an audit must be

done at least every 2 years. The au-

dit requested by the petitioners will

be in addition to the annual audit

and may cost an additional $30,000

which will need to be paid by the

school district.

Discussion was held on the petition,

financial implications of the addition-

al audit, and consequences of the

stigma of a petitioned audit.

Activity bus design options were dis-

cussed. Consensus from the board

to choose designs #3 and #4. The

district will pay up front for the cost,

but will pay back with fundraising

money. Taxpayer dollars will not be

used to pay this cost.

Principal report was given by Princi-

pal Jenkins.

NDSBA Convention was October

28th & 29th in Bismarck. Erickson,

Pank, Brown and Ritteman attend-

ed. Discussion was held on speak-

ers.

Superintendent Evaluation was con-

ducted. Motion by Brown/Deaver to

approve the Superintendent Evalua-

tion as completed. All yes. MC.

A mandatory pre-Bid conference for

interested bidders will be held on

January 4, 2022, from 10:00 AM

CDT until 11:00 AM CDT. The

conference will be hosted on Micro-

soft Teams, and will also be acces-

sible via a call-in conference line. All

bidders planning on attending the

meeting shall send an invite request,

via email, with the subject “MI-4B

Pre-Bid” to Joe Reiter at

jreiter@houstoneng.com prior to

Noon on January 3rd, 2022. Invites

shall be sent to the sending email

address of the request. Prospective

prime bidders are required to have

at least one representative present

at the pre-bid conference. Atten-

dance will only be taken once by the

Engineer at the beginning of the

conference. All prime bidders listed

on the attendance sheet will be eligi-

ble to bid the project. Bidders that

are not listed on the attendance

sheet shall not be eligible to bid the

project as prime bidders. The En-

gineer will also be available, if re-

quested, to meet any prospective

bidders at the project site on Janu-

In general, the Work included in the

Project includes the labor, materials,

tools and equipment required to con-

struct MREFPP Phase MI-4B Maple

Diversion Raw Water Relocation as

fully depicted in the Drawings and

Project Manual for the Project. The

Project is located within the City of

Minot, North Dakota.

All Bids are to be submitted on the

basis of cash payment for the Work,

and are to be enclosed in a sealed

envelope addressed to the under-

signed Chairman, endorsed as re-

quired below. The bid security must

be in a sum equal to five percent

(5%) of the full amount of the Bid

and must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the Bid and the bid bond

and any condition of the governing

body. A countersignature of a bid

bond is not required. If a successful

bidder does not execute a contract

within the ten days allowed, the

bidder’s bond must be forfeited to

the governing body and the project

awarded to the next lowest responsi-

ble bidder. The bidder must be

licensed for the full amount of the

bid as required by Section 43-07-12

of the North Dakota Century Code.

The outside of the sealed envelope

containing the bid and other required

items shall be endorsed with the fol-

lowing verbiage:

1. “Souris River Joint Water

Resource Board, Mouse River

Water Relocation”

2. The name of the person, firm, cor-

poration, or joint venture submitting

the Bid.

3. The Bidder’s Contractor’s License

4. Acknowledgement of Addenda.

A copy of the Bid Bond and Bidder’s

Contractor’s License or Contractor’s

License Renewal shall be included a

separate envelope from the bid.

No Bid may be read or considered if

it does not fully comply with the re-

quirements of Section 48-01.2-05 of

the North Dakota Century Code. Any

deficient Bid received will be

resealed and returned to the Bidder

immediately.

The Owner reserves the right to hold

all bids for 60 days, to reject any or

all Bids and to waive any informality

or irregularity in any Bid and to ac-

cept the Bid deemed in the best in-

terest of the Owner. The Owner

reserves the right to rebid the project

until a satisfactory Bid is received.

The Work shall be substantially

complete by November 1, 2022. All

Work shall be complete and ready

for final payment in accordance with

the General Conditions by June 1,

2023.

Should the Contractor fail to com-

plete its obligations under the Con-

tract within the time required herein

or within such extra time as may

have been granted by formal exten-

sions of time approved by the Own-

er, there will be deducted from any

amount due to the Contractor the

sum of $900 per day (with no

suspension for winter work) for each

and every calendar day that the sub-

stantial or final completion of the

Work is delayed. The Contractor and

its Surety will be liable for any ex-

cess. Such payment will be as and

for liquidated damages and not as a

penalty.
