THE ISSUANCE OF

MORTGAGE REVENUE

REFUNDING BONDS UNDER THE

MUNICIPAL INDUSTRIAL

DEVELOPMENT ACT OF 1955

(MINOT FAMILY YMCA PROJECT)

NOTICE IS HEREBY GIVENthat the

Board of County Commissioners of

Ward County, North Dakota, will

meet on May 18, 2021, beginning at

9:00 a.m. at the County Administra-

tion Building, 225 Third Street SE,

Minot, North Dakota, for the purpose

of holding a public hearing on a pro-

posal that the County issue revenue

bonds under the Municipal Industrial

Development Act of 1955, Chapter

40-57, N.D.C.C., in order to finance

the project described below.

Proceeds of the bonds will be ap-

plied to refund all of the outstanding

$6,500,000 original principal amount

Ward County, North Dakota, Munici-

pal Industrial Development Act

Revenue Refunding Bond (The

Young Men’s Christian Association

of Minot, North Dakota Project),

Series 2009 (the “Series 2009

Bonds”), together with associated

reserves, and costs of issuance. The

Series 2009 Bonds were used,

among other things, to refund the

Ward County, North Dakota, Muni-

cipal Industrial Development Act

Revenue Bond (The Young Men’s

Christian Association of Minot, North

Dakota Project), Series 2007 and re-

fund the Ward County, North Dako-

ta, First Mortgage Revenue Bonds

(Minot Family YMCA Project),

Series 2000 (the “Prior Bonds”).

Proceeds of the Prior Bonds were

used to construct and equip a

54,000 square foot facility and its

37,000 square foot expansion, locat-

ed at 3515 16th Street SW in Minot,

North Dakota, which include two

gymnasiums, a swimming pool, well-

ness center, climbing tower, rac-

quetball court, exercise area, track,

locker rooms, storage space, meet-

ing rooms, administrative offices and

rooms, and functionally related facili-

ties and other improvements (the

“Project”). The Project is owned and

operated by The Young Men’s

Christian Association of Minot, North

Dakota, a North Dakota nonprofit

corporation. The amount of the pro-

posed bond issue is not to exceed

$4,000,000. The bonds shall be lim-

ited obligations of the County pay-

able solely from the revenue pro-

vided by The Young Men’s Christian

Association of Minot, North Dakota

and pledged to the payment thereof.

No holder of any such bonds shall

ever have the right to compel any

exercise of the taxing power of the

County to pay the bonds, or the in-

terest thereon, nor to enforce pay-

ment against any property of the

County. The Young Men’s Christian

Association of Minot, North Dakota

is engaged in providing recreational,

social, and human service programs

and facilities, to better meet the

health and human service needs of

its service area and competitors are

hereby notified of that fact pursuant

to Chapter 40-57, N.D.C.C. All per-

sons interested may appear and be

heard at the time and place set forth

above or may submit their views in

writing to the County

Auditor/Treasurer prior to the time of

the hearing. Any member of the pub-

lic seeking to submit comments re-

lating to the public hearing may sub-

mit their comments to

marisa.haman@wardnd.com. All

comments received prior to 9:00

a.m. on the meeting date will be

considered part of the record of the

meeting as if personally presented.

to the entered Judgment. Said Mort-

gage was assigned to Plaintiff, its

successors or assigns, by Assign-

ment of Mortgage recorded No-

vember 4, 2019, Instrument Number

3033383.

3.In order to realize the amount of

$216,543.33, as of April 9, 2021,

plus interest accruing thereafter on

said amount at the rate of 4.241%

per year together with the costs and

expenses of sale, the property will

be sold subject to redemption as

provided by law as one parcel of

land at public auction, subject to any

lien for unpaid real estate taxes and

assessments of Ward County, North

Dakota, and easements and res-

trictions of record, to the highest

bidder for cash under the direction of

the Sheriff of Ward County, North

Dakota, at the main entrance of the

Ward County Courthouse located at

315 SE 3rd Street, Minot, North

Dakota 58701, on June 16, 2021

4.If the sale is set aside for reason,

the Purchaser at the sale shall be

entitled only to a return of the depo-
