Defendant sentenced to time served for hallucinogens

A Minot woman who entered a change of plea to guilty for possession with intent to distribute a schedule I hallucinogenic substance, a Class B felony, was sentenced to time served and probation in North Central District Court on Friday.

Donesha Yanay Greene, 36, Minot, was charged in March 2023 following a probation search of a residence including investigators from the Ward County Narcotics Task Force. According to the affidavit of probable cause, a variety of marijuana paraphernalia was found littered throughout the home, along with about two ounces of psilocybin mushrooms. Greene was receiving methadone doses as a part of her probation conditions, but admitted to investigators after receiving her Miranda Advisement that she had smoked fentanyl four days prior to the search. Greene was initially charged with additional counts for endangerment of a child, a Class C felony, and unlawful possession of drug paraphernalia, a Class A misdemeanor, but both were dismissed in accordance with the plea agreement.

Judge Todd Cresap sentenced Greene to serve four days of a 10-year sentence with the Department of Corrections and Rehabilitation and to complete two years of supervised probation. Greene was ordered to complete a chemical dependency evaluation and to pay $775 in court fines and fees. The $700 seized during the search of her residence was forfeited to the Ward County Narcotics Task Force.
