NOTICE IS HEREBY GIVEN that

the City of Minot, North Dakota will

receive sealed Bids for the con-

struction of STORM SEWER DIS-

TRICT 123, at the office of the City

Clerk, 515 Second Avenue SW

(Second Floor), Minot, North Dako-

ta, until 11:00 AM Tuesday, April 14,

2020, at which time all Bids will be

publicly opened and read in the

Council Chambers. All Bids must be

submitted, and all work shall be

done, in full and strict compliance

with: 1. The Plans & Contract Docu-

ments for this project; 2. Any Special

Conditions for this project; 3. The

2019 City of Minot Standard Specifi-

cations and Details. Project bidding

erally, the Work covered by the

Plans and Specifications for Storm

Sewer District 123 consists of the

materials, labor, tools, and equip-

ment required for the construction of

storm sewer improvements and the

reconstruction of intersections along

10th Street SW. The Work includes

approximately 5,700 LF of storm

sewer along 10th Street SW, 34th

Avenue SW, 32nd Avenue SW, and

7th Street SW. The Work shall also

include the removal and replace-

ment of about 5,000 LF of curb &

gutter, 9,300 SY of cement stabil-

ized base, 3,800 Ton of asphalt

pavement, and other incidentals as

necessary to complete the project.

Details of the construction are in-

cluded in the Drawings, Project

Manual, and the 2019 City of Minot

Standard Specifications and Details.

All Bids are to be submitted on the

basis of cash payment for the Work

and Materials necessary to complete

the project. Each bid must be ac-

companied by a separate envelope

containing the contractor’s license

and bid security. The bid security

must be in a sum equal to five per-

cent of the full amount of the bid and

must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the bid and the bid bond

and any condition of the governing

body. A countersignature of a bid

bond is not required under this sec-

tion. If a successful bidder does not

execute a contract within the ten

days allowed, the bidder’s bond

must be forfeited to the Owner and

the project awarded to the next

lowest responsible bidder. Bidders

must be licensed for the full amount

of the bid as required by section

43-07-12 of the North Dakota Centu-

ry Code. No Bid may be read or con-

sidered if it does not fully comply

with the requirements of Section

48-01.2-05 of the North Dakota Cen-

tury Code. The Owner reserves the

right to hold all Bids for 30 days, to

reject any or all Bids, to waive any

informality or irregularity in any Bid,

to accept the Bid deemed in the best

interest of the Owner, and to rebid

the project until a satisfactory bid is

received. There shall be endorsed

upon the outside of the envelope

containing the Bid, the following: 1.

“City of Minot, North Dakota, Storm

Sewer District 123, Project Number

4393”. 2. The name of the person,

firm, corporation, or joint venture

submitting the Bid. 3. The Bidder’s

Contractor’s License or Contractor’s

License Renewal Number. 4. Ack-

nowledgement of the Addenda, if

any. Any deficient Bid received will

be resealed and returned to the

Bidder immediately. Milestone 1 in-

cludes storm sewer and roadway

reconstruction for Sta. 20+91 to

33+00 and 61+50 to 67+00, to

be completed by July 15, 2020. All

work shall be substantially complete

by October 16, 2020. All work shall

be completed and ready for final

payment in accordance with the

General Conditions by October 30,

2020. Should the Contractor fail to

complete its obligations under the

Contract within the time required

herein or within such extra time as

may have been granted by formal

extensions of time approved by the

Owner, there will be deducted from

any amount due to the Contractor

the sum of $1,000 per day for each

and every calendar day that the

completion of the Work is delayed.

The Contractor and his Surety will

be liable for any excess. Such pay-

ment will be as and for liquidated

damages and not as a penalty.

Prospective Bidders may examine

containing a bidder’s bond in a sum

bid executed by the bidder as princi-

complete by August 7, 2021. All

(with no suspension for winter work)

for each and every calendar day that

the substantial or final completion of

the Work is delayed. The Contractor
