A hearing has been scheduled for December regarding a motion by a North Dakota broadcaster to quash a subpoena filed by the state in the trial of a Surrey man charged in the 2023 shooting death of a service member in Minot.

Daniel Breijo, 41, faces five felony counts in connection with the Dec. 24, 2023, shooting, which left Nicholas Van Pelt dead and the surviving female victim seriously injured.

The hearing regarding BEK TV’s motion to quash has been set for Wednesday, Dec. 17, when the parties will make their oral arguments before District Court Judge Daniel El-Dweek. Special Ward County State’s Attorney Amanda Engelstad had issued a subpoena in October, seeking to compel BEK TV to provide any unaired interview footage, notes and communications with the surviving witness and alleged victim in the case.
