Sentenced for aggravated assault

A Minot man was sentenced to serve six days of a 10 year sentence after pleading guilty to a felony related to a domestic violence incident in January.

Benjamin Phillip Johnson, 22, Minot, entered his change of plea in North Central District Court on Tuesday, pleading guilty to Class B felony aggravated assault-domestic violence-permanent loss or impairment, and violation of an order prohibiting contact, a Class A misdemeanor.

According to court documents, Minot Police were dispatched to southeast Minot on Jan. 25 after a resident reported hearing screaming outside his home. Officers arrived and made contact with the victim. Police made contact with Johnson who claimed he and the victim had been arguing, and that it became physical. Johnson was arrested, and he and the victim were taken to a Minot emergency room to be medically cleared.

Judge Richard Hagar sentenced Johnson to 10 years with the Department of Corrections and Rehabilitation for the aggravated assault count, to first serve six days with credit for six days already served. Johnson was ordered to complete three years of supervised probation upon release, along with a domestic violence course. He was also assessed $775 in court fines and fees.

Hagar also sentenced Johnson to 360 days in the Ward County Jail, to first serve eight days with credit for eight days served. Johnson was ordered to complete two years of supervised probation, and to pay $125 in court fines and fees.
