Cody Faltersack, Fargo, sentenced to 23 1/2 years for killing girlfriend’s baby

Cody Allen Faltersack, 25, Fargo, will serve about 23 1/2 years in prison for killing his girlfriend’s baby in Stanley on Nov. 16.

Faltersack was sentenced on Aug. 8 in district court.

Court records show that Judge Todd Cresap sentenced him to a total of 35 years in prison, with a requirement that he first serve 23 1/2 years, followed by five years of supervised probation. Faltersack will receive credit for 265 days already served. He must serve at least 85 percent of his sentence. He was also ordered to have no contact with the victim’s family and to pay restitution and court costs.

Faltersack had been babysitting for his girlfriend’s 6-month-old son and had been playing video games. He admitted to “bouncing the baby harder than he should” when he cried and continuing to bounce him even after the baby started whimpering and having a hard time breathing. Faltersack also dropped the baby on the left side of his head when he went to put him down on a bed. Faltersack called for an ambulance but didn’t tell the ambulance crew what had happened. The baby could have sustained further injury during treatment because Faltersack did not tell the truth. The baby later died of brain trauma at Trinity Hospital in Minot.
