NOTICE IS HEREBY GIVEN that

the City of Minot (Owner) is re-

questing Bids for the construction of

Each bid must be accompanied by a

separate envelope containing the

bid security in a sum equal to five

percent of the full amount of the bid

and must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the bid and the bid bond,

and any condition of the City of

Minot, as required by law. A counter-

signature of a bid bond is not re-

quired. If the City of Minot elects to

award a contract to the lowest

responsible bidder, and the lowest

responsible bidder does not execute

a contract within the ten days al-

lowed, the bidder’s bond must be

forfeited to the City of Minot and the

project awarded to the next lowest

responsible bidder.

Each bidder must possess a valid

North Dakota contractor’s license for

the full amount of their bid, as re-

quired by Section 43-07-07 of the

North Dakota Century Code. Each

bidder MUST enclose a copy of their

Contractor’s License or Certificate of

Renewal, issued by the North Dako-

ta Secretary of State, in their bid

bond envelope, and each license

must be valid and dated at least 10

days prior to the date set for bid

opening, as required under Section

43-07-12 of the North Dakota Centu-

ry Code.

No bid may be read or considered if

it does not fully comply with the re-

quirements of Section 48-01.2-05 of

the North Dakota Century Code, and

any deficient bid submitted will be

resealed and returned to the bidder

immediately.

All Bids submitted and all Work

completed must be as stipulated in

the Contract.

The City of Minot reserves the right

to hold all Bids for a period of 30

days after the date of the bid open-

ing, to reject any or all Bids and to

rebid the project until a satisfactory

bid is received, and to waive any in-

formality or irregularity in any Bid.

In general, the Work included in the

Project includes the labor, materials,

tools, and equipment required to

construct MREFPP Phase BU-1D

Burlington as fully depicted in the

Drawings and Technical Specifica-

tions for the Project. The project is

located within the City of Burlington,

North Dakota.

All Bids are to be submitted on the

basis of cash payment for the Work,

and are to be enclosed in a sealed

envelope addressed to the under-

signed Chairman, endorsed as re-

quired below. Each bid must be ac-

companied by a separate envelope

containing the contractor’s license

and bid security. The bid security

must be in a sum equal to five per-

cent (5%) of the full amount of the

Bid and must be in the form of a

bidder’s bond. A bidder’s bond must

be executed by the bidder as princi-

pal and by a surety, conditioned that

if the principal’s bid is accepted and

the contract awarded to the princi-

The Work shall be substantially

complete by July 28, 2023. All Work

shall be complete and ready for final

payment in accordance with the

General Conditions by September

29, 2023.

Should the Contractor fail to com-

plete its obligations under the Con-

tract within the time required herein

or within such extra time as may

have been granted by formal exten-

sions of time approved by the Own-

er, there will be deducted from any

amount due to the Contractor the

sum of $5,000.00 per day (with no

suspension for winter work) for each

and every calendar day that the sub-

stantial or final completion of the

Work is delayed. The Contractor and

his Surety will be liable for any ex-

cess. Such payment will be as and

for liquidated damages and not as a

penalty.

City Council Meeting

MINOT CITY COUNCIL –

SCHEDULED MEETING –

JANUARY 3, 2022 AT 5:30 P.M.

Members Present: Evans, Jantzer,

Olson, Pitner, Podrygula, Ross,

Members Absent: None

Mayor Sipma presiding and led the

City Council in the Pledge of

Allegiance.

The Mayor described some of his

meetings and activities over the past

month. He also said, there were

numerous other meetings, phone

calls, e-mails, and individual con-

tacts concerning City business.

Alderman Jantzer moved the City

Council approve the Visit Minot

Board Commissioner appointment of

Thor Nelson with a term of January

1, 2022 to expire January 1, 2025.

Motion seconded by Alderwoman

Olson and carried by the following

roll call vote: ayes: Evans, Jantzer,

Olson, Pitner, Podrygula, Ross, Sip-

ma; nays: none.

The City Manager provided a written

update describing events and activi-

ties for various departments.

The City Attorney submitted a writ-

ten report.

The City Council held a public hear-

ing for Gabriel Holt representing

TITA, LLC who recently constructed

a commercial automated car wash

located at 619 N Broadway. The

Minot City Council previously voted

for a conditional approval of this

Renaissance Zone project on De-

cember 7, 2020.

Alderwoman Evans thanked Mr. Holt

for his patience during this process.

No one appeared in favor or op-

posed to the request.

Alderwoman Evans moved the City

Council grant final approval of

Renaissance Zone Case M-96 filed

by TITA, LLC for a five-year property

tax exemption including improve-

ments and land, and for a State In-

come Tax exemption. Motion was

seconded by Alderman Pitner and

carried by the following roll call vote:

Podrygula, Ross, Sipma; nays:

none.

Council approved the administrative

approval requests. Motion seconded

Alderman Ross moved the City

Council approve the request to

amend 2022 annual budget to in-

crease fire control operational sup-

plies for physical fitness equipment

to be used by the firefighters with a

donation from Scheels. Motion

Alderman Ross moved the City

Council approve the contract of

boarding the City of Minot’s inmates

with Ward County and authorize the

Mayor and Finance Director to sign

the contract. Motion seconded by

Alderwoman Olson and carried by

the following roll call vote: ayes:

Evans, Jantzer, Olson, Pitner, Po-

drygula, Ross, Sipma; nays: none.

Mayor Sipma stated that SRJB is

giving the option to repair the south

side of the bridge for $1.6 million.

City of Minot would be responsible

for the north side of the bridge. Dan

Jonasson thought that it would be

one million +/- for the north side

construction. Alderwoman Olson

asked when the last time the bridge

was in use. Dan Jonasson stated

that it was last accessed over 2

years ago and was originally closed

with the MI-1 flood project. Alderman

Ross wanted to confirm with Dan

that the bridge reconstruction on the

north side would not have to be

completed at the same time as the

south side. Dan just established that

the SRJB is just looking for the com-

mitment to the bridge before they

repair the south side. SRJB funding

is 65% State Water Commission

and 35% City flood dollars. Mayor

Sipma and Dan Jonasson said the

City of Minot would have to work

with BNSF on a new lease agree-

ment.

Alderwoman Evans made a motion

for the City of Minot to retain access

to the Anne Street Bridge and add it

back to the CIP. The motion was

seconded by Alderman Podrygula.

Alderman Pitner inquired about the

process with BNSF and permitting.

Dan Jonasson said he could start

some discussion in the monthly

meetings he has with BNSF. Alder-

man Ross asked if any discussions

with BNSF had happened and Dan

could not think of any at this time.

Mayor Sipma reiterated that he has

spoken with BNSF about possible

cost share and they are not interest-

ed.

Mayor Sipma opened discussion to

public. Josh Wolsky with the Down-

town Business Professional Associ-

ation, had a presentation. He dis-

cussed the history of the bridge, how

it benefits the downtown district and

school district. Josh spoke of the

possibility to connect it to a green

space if the City of Minot is able to

acquire certain land. He also men-

tioned different ideas of funding of

the bridge and possible revenue for

downtown businesses with the

pedestrian access to the north side

of Minot.

Logan Vettel spoke of the history of

Anne Street Bridge, his personal

reasons for wanting the bridge to

remain, and what the bridge means

to the community. Shawn Antani

also spoke to the council about the

benefits to maintaining the bridge for

pedestrians. Ryan Ackerman stated

how personally he would love to

keep the bridge but professionally he

is unsure if the BNSF would permit

this. He spoke about the SRJB can-

not say that 1st Ave will be

developed fully with MREFPP. The

railroads have indicated no willing-

ness to sell right of way or lad west

of Main Street and South of the

BNSF mainline. Ryan feels this is

out of the scope of the flood plan. He

also noted that the more we spend,

the longer it takes to complete, and

at whose expense. Alderman Pitner

asked Ryan Ackerman if he could

confirm if the downtown flood pro-

tection would be flood walls or

levees. Ryan stated the area would

be protected primarily with levees.

Shannon Straight spoke about

greater access with the bridge for

the north side of Minot and down-

town, how it is a connection in Minot.

Shannon Straight brought up the

loss of one bridge with MI-5 near the

Ben’s Tavern area.

Mayor Sipma said that through

conversations with BNSF there is no

interest in a design of a new bridge.

The City Manager, Harold Stewart,

brought up the fact that the council is

facing 2 values in conflict

efficiency/effectiveness

vsaccountability/responsibility. He

wanted the council to know that the

City Council has brought significant

attention to downtown with past pro-

ject and ongoing projects. There

was discussion by the council

members of being stewards of tax-

payer dollars. Alderman Pitner

spoke about changes in the com-

munity with the school bond appro-

val and the public survey results.

Mayor Sipma expressed the fact that

the longer we draw out the flood

plans the higher the flood insurance

costs are going.

Whereupon a vote was taken on the

above motion by Alderwoman

Evans, seconded by Alderman Po-

drygula and carried by the following

Podrygula, Ross; nays: Jantzer, Ol-

City Manager, Harold Stewart, stat-

ed that contractors have made signi-

ficant progress and their compliance

time would be extended to the Fri-

day prior to the next regular city

council meeting.

Alderwoman Olson moved the City

Council approve the removal of pay-

roll and human capital management

phase from the ERP Project agree-

ment with Tyler Technologies, Inc.

Motion was seconded by Alderman

Jantzer.

Alderwoman Evans asked the City

Manager what alternatives were in

place. It was mentioned that for now

the old software would work but the

City of Minot will not be able to up-

date the software past December

31, 2022. The project will need to go

to RFP again.

Alderman Podrygula inquired about

if Tyler was going to refund City of

Minot in full including staff time

spent. The City Manager replied that

the city would only get reimbursed

for software/equipment costs and

not for staff/payroll time. Alderman

Podrygula then spoke on the idea of

legal recourse to try to obtain full re-

fund. Kelly Hendershot stated that

she was involved in discussions with

Tyler and that the City of Minot tried

to get the cost refunded for staff time

but in the end, we would only get the

cost for products/software back.

Alderman Podrygula would like to

see future contracts have more at-

tention to the needs of the City of

Minot. Harold responded with exam-

ples of new contracts that are more

beneficial to the City of Minot and in-

clude penalties.

Lance Meyer, City Engineer, intro-

duced Andy Mielke with SRF con-

sulting to do a presentation on Rail-

road Quiet Zones. Quiet zones are

where no routine horn sounds but

emergency horns are allowed. The

study is based on the risk analysis

using the DOT Accident Prediction

Model. He discussed how there are

4 options for improvements. City of

Minot has 8 CP RR crossing that

were considered with 3 recommen-

dations to upgrades. The 3 include:

3rd St SE needing 4 quadrant gates

for $402,000, Central Ave E needing

medians for $103,000, and 3rd

St/Amtrak Depot needing gates and

median for $390,000 for a total pro-

ject cost of $895,000.

Mayor Sipma mentioned the access

cutoff for businesses on Central

Ave. Alderman Podrygula asked the

speaker Andy Mielke to discuss the

volume of fixed horn vs train horn.

Andy mentioned that a fixed horn is

roughly 90-100 decibels and a train

horn is 110 decibels. Reusing Maple

Street equipment was discussed but

the city was told that it is usually not

allowed. Alderwoman Evans in-

quired about how each improvement

plan was figured out and Andy men-

tioned that every crossing was

looked at individually and the risk

was assessed at each place.

Alderman Jantzer motioned the City

Council receive and file the report

and place the Quiet Zone on the up-

coming CIP. The motion was

seconded by Alderman Podrygula.

Leonard Niess, owner of Niess Im-

pressions spoke about the access to

his loading dock being blocked. His

building has no way of getting pro-

duct or equipment out. Niess Im-

pressions is located at 101 Central

Ave. Lance Meyer reiterated that the

railroad has blocked off the access

to his loading dock currently and that

there is no Quiet Zone work on Main

Street and 1st Street NE. Leonard

Niess believes that the Quiet Zone

study might be what triggered the

railroad to cut off access to his alley-

way loading dock area.

Alderman Pitner asked Lance about

the timeline for this and Lance

responded that this could be funded

as early as 2023 on the CIP. Alder-

man Jantzer stated that he wanted

the City of Minot to find a way to

help and/or work with Niess Impres-

sions so that the business can gain

access back to the loading dock.

Alderman Jantzer moved the City

Council approved the plans and

specs for bid of building relocation

on MI-5B and allow authorization to

bid. The motion was seconded by

Alderman Ross.

Alderman Podrygula asked Dan Jo-

nasson if this building would be the

only storage for the flood wall stop

logs. Dan replied that this building

would hold a majority of the logs but

the Water Treatment Plant stores

their stop logs on site and there are

a few lift stations that also store on

site. Dan also mentioned that is

more cost effective since the equip-

ment is already at Public Works to

move the stop logs.

Alderwoman Evans wanted to know

how often the City Council approved

funds for entities outside of the City

of Minot. David Lakefield spoke on

this by saying there has not been a

lot of activity with the Magic Fund

but this qualifies since it is in the

Minot trade area.

A vote was taken on the above mo-

tion by Alderwoman Olson, second-

ed by Alderman Ross and carried by

the following roll call vote: ayes:

Evans, Jantzer, Olson, Pitner, Po-

drygula, Ross, Sipma; nays: none.

There were no personal appear-

ances.

Alderman Podrygula wanted to clari-

fy that he was not questioning the

Mayor on the BNSF relationship with

the City of Minot. He just wanted to

know if MacBeth had the authority to

speak on the Anne Street Bridge

lease agreement.

Mayor Sipma responded that Mac-

Beth was the Regional Director of

Public Affairs for the BNSF. He

reiterated that the BNSF has had a

close partnership with the City of

Minot and its importance.

Alderman Pitner also expressed the

importance of the relationship

between the City of Minot and BNSF

Railroad.

There being no further business,

Alderman Pitner moved the City

Council meeting be adjourned. Mo-

tion seconded by Alderman Ross

and carried unanimously. Meeting

adjourned at 8:15 pm.

The City of Minot is a Title VI com-

munity and requires that all con-

tracts entered into with the City of

Minot comply with all Civil Rights Act

of 1964 Title VI assurances. The as-

surances prohibits discrimination on

the basis of race, color, and national

origin. Specifically, 42 USC 2000d

states that “No person in the United

States shall, on the ground of race,

color, or national origin, be excluded

from participation in, be denied the

benefits of, or be subjected to

discrimination under any program or

activity receiving Federal financial

assistance.” In addition to Title VI,

there are other Nondiscrimination

statutes which include: Section

162(a) of the Federal-Aid Highway

Act of 1973 (23 USC 324) (sex), Age

Discrimination Act of 1975 (age),

and Section 504 of the Rehabilita-

tion Act of 1973/ADA of 1990 (disa-

bility). Taken together, these re-

quirements define an over-arching

Title VI/Nondiscrimination and ADA

Program. Title VI and the additional

Nondiscrimination requirements are

applicable to programs receiving

federal financial assistance due to

the Civil Rights Restoration Act of

1987.

There are two Presidential Executive

Orders that place further emphasis

upon the Title VI protections of race

and national origin. Executive Order

12898 ensures nondiscrimination

against minority populations by

discouraging programs, policies, and

activities with disproportionately high

and adverse human health or en-

vironmental effects on minority and

low-income populations. Executive

Order 13166 directs recipients of

Federal financial assistance that to

ensure compliance with Title VI,

they must take reasonable steps to

ensure that limited English proficien-

cy persons have meaningful access

to their programs.

All Bids are to be submitted on the

basis of cash payment for the Work,

and are to be enclosed in a sealed

envelope addressed to the under-

be in a sum equal to five percent

(5%) of the full amount of the Bid

and must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

notice of the award, shall execute a
