Minot man charged for assault with 2×4
A Minot man has been charged with aggravated assault for allegedly striking his neighbor with a 2×4, resulting in serious injuries.
Samuel Tyler Mauck-Velasquez, 33, is charged with one count of aggravated assault in North Central District Court and made his initial appearance on Feb. 27.
According to court documents, Minot Police were dispatched to a southwest Minot apartment after a report was made regarding a man standing in the door of his apartment holding a board and threatening people. A second call was made to dispatch by Mauck-Velasquez, who reported his neighbor had hit him with a board and that he had pinned him to the floor.
Responding officers arrived to find Mauck-Velasquez standing over the alleged victim, lying on his right side. The officers observed blood pooling around the alleged victim’s head. The victm exhibited labored breathing and appeared unresponsive, according to the affidavit.
Mauck-Velasquez told officers the victim had run toward him with the wooden board, but he took the board away from him and struck him on the head. Another resident of the apartment building provided video footage of the incident to law enforcement, who then put Mauck-Velasquez under arrest after determining his actions surpassed what was necessary for self-defense, according to the affidavit of probable cause.
According to court documents, the video footage reviewed by law enforcement showed Mauck-Velasquez walking toward the alleged victim before lunging at him and throwing him to the ground. Mauck-Velasquez proceeded to punch the victim 12 times in the head, followed by five strikes to his head with the piece of wood.
Mauck-Velasquez is in custody at the Ward County Jail on a $250,000 corporate/surety bond and is scheduled to appear for a preliminary hearing on April 2.
