Federal grand jury indicts for firearms charges

A Minot man previously convicted of a number of narcotics related felonies was indicted by a federal grand jury on Thursday, Feb. 5, with two counts of possession of a firearm by a felon or unlawful user.

Todd Michael Behm, 54, Minot, was originally charged with seven felonies in North Central District Court on Oct. 1, 2025, including possession of fentanyl with intent to distribute, a Class B felony; two counts of possession of drug paraphernalia, possession of methamphetamine-second offense, and three counts of possession of a firearm-felon or violent misdemeanor, all Class C felonies. All seven district counts were dismissed on Feb. 5 after the federal grand jury indictments were unsealed.

Behm pleaded guilty on May 14, 2020, to possession of MDMA and marijuana with intent to deliver, both Class B felonies; possession of methamphetamine-second offense, maintaining a premises for the use, storage, or sale of controlled substances, both Class C felonies; and one count of unlawful possession of drug paraphernalia, a Class A misdemeanor.

According to court documents, on or about Sept. 30, 2025, Behm was charged after a probation and parole search of his residence with assistance from the Ward County Narcotics Task Force. During the search, officers located quantities of fentanyl which exceeded the amounts typically possessed by a user. An additional search warrant was sought and executed, resulting in the discovery of a large variety of narcotics and distribution paraphernalia, approximately 10 grams of methamphetamine and 16 grams of fentanyl, along with three firearms.

According to the federal indictment, Behm is charged with allegedly affecting commerce with three firearms and 85 rounds of ammunition in various calibers. The firearms and ammunition have been forfeited to law enforcement.

Behm is currently being held at the Ward County Jail with no bond pending his first appearance in federal court.
