Minot man sentenced to time served for terrorizing incident
A Minot man has been sentenced to time served after pleading guilty to four counts of terrorizing in connection with an incident at a restaurant in May.
Justyn Montana Smith, 35, Minot, appeared in North Central District Court on Thursday, Aug. 7, for a preliminary hearing before District Judge Steven Lautt. Smith pleaded guilty to four counts of terrorizing-adult victim, a Class C felony.
According to court documents, Smith was charged on May 28 after Minot Police received a report by an employee of a Minot restaurant that a man had pulled out a firearm and showed it to staff. Reporting staff who had evacuated the restaurant told responding officers that Smith had made threatening comments while dry firing and racking the slide of a green gun.
Officers entered the restaurant and made contact with Smith. They discovered he was in possession of a realistic replica BB gun.
Lautt sentenced Smith to a concurrent sentence of five years with the Department of Corrections and Rehabilitation for all four counts, to first serve 82 days. Smith was given credit for 72 days served and 10 days of earned good time. He was ordered to have no contact with the four victims, and the BB gun to be forfeited to law enforcement. He was also assessed $525 in court fines and fees.
