Stanley man sentenced for knife assault

A Stanley man has been sentenced to serve two years of a four year sentence with the Department of Corrections and Rehabilitation after entering a change of plea to guilty to three Class C felony counts on Thursday.

Daniel Scott Pelzl, 42, Stanley, entered his change of plea in North Central District Court to guilty on three counts, aggravated assault-domestic violence with a dangerous weapon, assault on peace officer, and criminal mischief-willful damage-intentional $2,000 to $10,000.

According to court documents, Stanley Police officers were flagged down in the early morning of Feb. 17 by the victim, who stated Pelzl had been drinking and attacked her with two kitchen knives. The victim said she was stabbed in the hand after raising her hands to defend herself and alleged Pelzl threatened to burn their residence down.

Officers arrested Pelzl at his residence for the assault charge, where multiple knives and lighters were located. He was transported to a Stanley hospital to be medically cleared before booked into the Mountrail County Correctional Center. Pelzl became aggressive during the intake process,and ripped a computer out of a desk before officers were able to calm him down, court documents state. Officers noted after being placed in a cell, Pelzl threatened to kill the corrections officers and law enforcement.

According to court documents, Pelzl was further charged following an incident on Feb. 26 at the MCCC when he damaged a 50-inch television and a cell kiosk and assaulted a correctional officer, causing injury. The combined damages to the property was estimated to be $2,075.76.

Judge Douglas Mattson sentenced Pelzl to first serve two years of a four year sentence with the Department of Corrections and Rehabilitation for the assault charge, with credit for 160 days already served. Pelzl was ordered to complete a domestic violence program and to complete three years of supervised probation upon release.

Mattson ordered Pelzl to a concurrent sentence for the second and third counts of assault on an officer and criminal mischief. He is to serve 182 days in the MCCC, with credit for 160 days already served and 22 days of good time. The Class C felonies will be deemed misdemeanors pending the completion of supervised probation. Pelzl was assessed $250 in court fines and fees and ordered to pay $2,075.76 in restitution.
