Defendant sentenced on drug charges

A Jamestown man has been sentenced to serve 29 days after pleading guilty to three felony counts for drug and paraphernalia possession.

Jacob Ray Wangrud Eberhardt, 24, Jamestown, entered a plea of guilty in North Central District Court on April 4 in a case that originated on Jan. 14, 2019. Eberhardt was initially charged with four Class C felonies that included three counts of possession of a controlled substance, unlawful possession of drug paraphernalia-manufacture-SI, SII, SIII, and a count of possession of marijuana paraphernalia, a Class B misdemeanor.

According to court documents, the charges against Eberhardt came after a probation search of a hotel room he was living in on Jan. 14, 2018, in Minot. A search of a safe in the room resulted in the discovery of a small baggie of heroin and other items.

Eberhardt posted bond on Jan. 17, 2019, which was later revoked in March 2019 after he failed to report for testing, resulting in the issuance of an order to apprehend and a bench warrant for his arrest. The court record stalled until March 11, 2024, when Eberhardt was arrested on the bench warrant from 2019. Eberhardt entered into a plea agreement with the state, resulting in the dismissal of one of the controlled substance possession charges and the marijuana paraphernalia misdemeanor.

Judge Richard Hagar sentenced Eberhardt to serve one year and one day with the Department of Corrections and Rehabilitation, to first serve a concurrent sentence on the three remaining counts of 29 days with credit for time served. Eberhardt was also required to complete two years of supervised probation and undergo a chemical dependency evaluation.

Eberhardt was also assessed $725 in court fines and fees while an indigent recoupment fee of $575 was waived.
