Mark Rogers appeals GSI conviction to North Dakota Supreme Court

Mark Allen Rogers, 69, is appealing his Class A felony gross sexual imposition case to the North Dakota Supreme Court.

Rogers is arguing that North Central District Court Judge Todd Cresap should not have denied his petition for post-conviction relief after an evidentiary hearing was held in March 2021. Rogers is claiming that his defense attorney did not represent him adequately. The prosecution argues that Cresap properly dismissed Rogers’ petition and his defense was adequate.

Rogers was sentenced in 2017 to 17 years, with five years suspended, after he pleaded guilty to sexually abusing an 8-year-old boy in 2014.

Oral arguments in the case are scheduled for Feb. 28 before the Supreme Court.
