Devante Harvey sentenced for contributing to the delinquency of a minor

Devante Damar Harvey, 23, Minot, pleaded guilty on Friday to Class C felony contributing to the delinquency of a minor via sexual conduct for having contact with 14-year-old girl in June 2019.

North Central District Court Judge Stacy Louser sentenced him to 360 days in the Ward County Jail, with all suspended but 30 days, and 18 months of supervised probation. He will be given credit for five days already served in jail and will be allowed to complete the remainder of the sentence via electronic home monitoring. He must also pay $525 in court costs and have no contact with the girl. If he successfully completes probation, the charge will be reduced to a Class A misdemeanor.

The state had originally charged Harvey with Class AA gross sexual imposition, a charge that was dismissed on Nov. 16, and Class C felony possession of child pornography.

According to court records, the alleged victim met Harvey on the social media app Tinder and communicated with him via the social media app Snapchat. She arranged to meet him in a location in the town where she had been living and claimed they had sex. She believed Harvey, who was 22 at the time, was about 18. Harvey admitted to conversing with the girl, buying vape pods for her and meeting her in a park but he denied having sex with her. He believed the girl, who was two months away from her 15th birthday at the time, was 18. Harvey had also allegedly received explicit photos of the girl, but had not asked for them to be sent to him, according to court document.
