Mylo Spotted Horse Jr., Katelin Spotted Horse charged with child endangerment

Mylo Scott Dawson Spotted Horse Jr., 33, and his wife, Katelin Marie Spotted Horse, 30, of Minot are accused of endangering their children by using drugs in their presence and exposing them to drugs on Friday.

Mylo Spotted Horse Jr. is charged in district court in Minot with two counts of Class C felony child endangerment; Katelin Spotted Horse is charged with Class C felony child endangerment, Class C felony possession of methamphetamine, Class C felony possession of fentanyl, and Class C felony possession of drug paraphernalia on Friday.

According to a probable cause affidavit filed with the court, three children were taken into custody by Ward County Social Services on Friday after Mylo Spotted Horse Jr. called the sheriff’s office and reported that one of his children had found his pregnant wife on the bathroom floor, barely breathing, after she had used heroin. Mylo Spotted Horse reported that his wife had then taken off on foot to a nearby residence, carrying one of their young children.

A deputy responded and was invited into the residence by Mylo Spotted Horse Jr. They found an empty syringe on the bathroom sink. Officers then located Katelin Spotted Horse and asked her to lift up her sleeves to expose her arms. There were multiple track marks on her left forearm and blood on her shirt. Katelin Spotted Horse claimed she was clean and hadn’t used heroin in a week. Police went back and talked with Mylo Spotted Horse Jr., who said he wanted his wife to get help but couldn’t drive her to the hospital because he has a suspended driver’s license. Katelin Spotted Horse returned and wanted to leave, but the deputy told her she would be taken to the hospital for a chemical dependency evaluation. A female deputy searched her and found a capped syringe in her pocket, with suspected drug residue on the top of the cap, and two cotton balls. Katelin Spotted Horse claimed it was a setup.

She was taken to the hospital to be evaluated and then to the jail, where she claimed she was using heroin for pain management. Based on statements made in court on Tuesday, Katelin Spotted Horse has been battling both uterine cancer and stage three liver cancer. Katelin Spotted Horse also told the deputy when she was arrested that she was 10 weeks pregnant. In court on Tuesday she told Judge Doug Mattson that she is scheduled for surgery on her liver at a facility in Minnesota that had to be delayed until she was past her 11th week of pregnancy. The judge asked her lawyer to gather more information for a hearing scheduled for today before he gives Katelin Spotted Horse permission to leave the state for the treatment.

According to the affidavit, Mylo Spotted Horse Jr. was tested by a social worker and tested positive for amphetamines and ecstasy after he called authorities. He led a deputy up to his bedroom, where another uncapped syringe was on a shelf in the bedroom closet. Mylo Spotted Horse Jr. gave permission to search the residence and the search turned up more drugs and drug paraphernalia.

Mylo Spotted Horse Jr. told the judge during his initial appearance that he had called the police because he was “trying to do the right thing to get my kids out of a bad situation.” He said he wants to work to get his kids back.

“I didn’t even know she was doing that stuff until my daughter came and told me she was on the floor,” Mylo Spotted Horse Jr. told the judge.

Judge Mattson set bond for Mylo Spotted Horse Jr. at $5,000 cash, with a requirement that he post 10 percent of that, or $500. Mattson also ordered Mylo Spotted Horse Jr. to have no contact with the children.

A preliminary hearing in the case is scheduled for Nov. 24.
