State dismisses simple assault on a peace officer charge against Jesse Fanning

The state dismissed a Class C felony charge of simple assault on a peace officer against Jesse Lee Fanning, 34, of Dickinson. Fanning pleaded guilty to a Class A misdemeanor charge of resisting arrest and was sentenced to 360 days in jail, all suspended but the one day he served, and 18 months supervised probation. He was also ordered to obtain a chemical dependency evaluation, pay $825 in court costs, and write a letter of apology to the officer. The incident happened on Oct. 4, 2019.

According to a probable cause affidavit filed with the court, Fanning had been accused of kicking an officer who placed him under arrest and of physically resisting the officers. Minot police had responded to a report of a disturbance at the Sports on Tap Bar parking lot in Minot. Fanning had reportedly been walking around and screaming and also screamed threats at the officers when they arrested him.
