Donald Mitchell, Minot, charged with sexually assaulting intoxicated 14-year-old girl at party

Donald James Dean Mitchell, 20, is charged in district court in Minot with sexually assaulting a 14-year-old girl on Dec. 1 and 2, 2018, a Class A felony. At the time Mitchell would have been 19.

Judge Doug Mattson set bond at $40,000 cash or corporate surety on Friday for Mitchell and set a preliminary hearing date for Sept. 17. Mitchell said he plans to ask for a court-appointed attorney. If he is convicted, Mitchell could face up to 20 years in prison, a minimum mandatory term of five years probation, and would be required to register as a sex offender. If he makes bond, Mattson ordered Mitchell not to have contact with the girl. Mitchell told the judge he does not know who the girl is.

According to the probable cause affidavit filed with the court, a video was taken at the party by a juvenile boy and sent to several people and eventually to the girl. The Snap Chat video shows the girl, under the influence of alcohol, lying unclothed on the bed with Mitchell straddling her.

The allegations were reported to police on Dec. 10, 2018, but the charge against Mitchell was not filed until Friday, 19 months later.
