Brady Schlak, Minot, sentenced to three years for conspiracy to deliver meth

Brady Earl Schlak, 32, Minot, was sentenced on Thursday to 10 years in prison, with a requirement that he first serve three years, followed by three years supervised probation, on a Class B felony conspiracy to deliver methamphetamine charge.

Court records show that the state dropped a Class B felony delivery of methamphetamine charge as part of a plea deal.

Judge Doug Mattson gave Schlak credit for 61 days already sesrved in jail, plus eight days time off for good behavior, and ordered him to pay $1,000 in court costs. Schlak must also obtain a chemical dependency evaluation.

Restitution of $800 is to be paid jointly with co-defendant Noah Figliolino, who is still facing charges in connection with the case. Figliolino has pleaded not guilty to the charges and intends to go to trial on the charges against him.

According to a probable cause affidavit filed with the court, a confidential informant working for the Ward County Narcotics Task Force gave Schlak $800 to buy one ounce of methamphetamine at Schlak’s residence on Dec. 10, 2019. Figliolino then delivered 18 grams of methamphetamine in a plastic bag to the confidential informant. The confidential informant confronted Schlak about the amount of the meth and Schlak admitted he didn’t sell the full ounce and said he would give the confidential informant the right amount. Schlak and Figliolino were arrested the following day as they were leaving a residence together. Both men were on supervised probation with the North Dakota Department of Corrections for previous offenses.
