Destiny Allen, Minot, charged with maintaining a drug house

Destiny Naeeba Nafisatou Allen, 25, Minot, is charged in district court with a Class C felony for allegedly maintaining a home where drug dealers have been selling drugs.

She was charged after three of her housemates were charged with drug dealing offenses last week. Tyrek Kevon London, 22, Minot, is charged in district court in Minot with Class A felony conspiracy to delivery 50 grams or more of methamphetamine, Class A felony delivery of 50 grams or more of methamphetamine, Class B felony intent to deliver a Schedule II narcotic, Class B felony intent to deliver marijuana, and Class C felony felon in possession of a firearm. His co-defendant Jaquan Kanye Austin, 20, of Minot, is charged with Class A felony conspiracy to deliver 50 grams or more of methamphetamine, Class B felony possession of a controlled substance in a correctional facility, Class C felony tampering with physical evidence, and Class A misdemeanor providing false information to law enforcement. Their co-defendant, Jamaiceo Javaris Nesbitt, 21, of Greer, S.C., is charged with Class A felony conspiracy to deliver 50 grams or more of methamphetamine.

London allegedly delivered 55 grams of methamphetamine for $1,300 to a confidential informant working for the Ward County Narcotics Task Force on March 6 at 413 4th Street SW. On March 11, task force officers staked out the home and saw someone go into the house and then come out and get in a car that drove away. That man was detained and told officers that he had bought 63 grams of marijuana from London at the residence. Officers obtained a warrant and searched the residence and found additional drugs, more than $10,000 in U.S. currency in different locations, firearms and ammunition.

According to a probable cause affidavit filed with the court in Allen’s case, Allen called the Ward County Narcotics Task Force and asked for information on the charges against her housemates and asked for exact bond amounts for each of the men. On Monday she called the Task Force Office again, told an officer that she was being evicted from her housing and asked to speak with him about what had happened at the residence. The officers met her in the Minot Municipal Auditorium parking lot. Allen wanted her brother, Y’Majesty Elijah-Divine Allen, 23, to come along even though the officers told her they would prefer that her brother not be present during the interview. Destiny Allen and her brother came to the parking lot together. She sat in the front seat of the patrol vehicle because it was cold and windy outside. One of the officers suggested that Y’Majesty Allen go to his car to sit and wait while Destiny Allen spoke with the officers. Y’Majesty Allen said he was not going to leave his sister. One of the task force officers asked to pat down Y’Majesty Allen for weapons. Y’Majesty Allen refused to let the officer pat him down. The task force officer was afraid Y’Majesty Allen might have weapons and ordered Y’Majesty Allen to get out of the vehicle and to put his hands on the vehicle because he was going to pat him down. The officer wrote that Y’Majesty Allen “resisted” the command but then put one hand on the vehicle. The officer patted Y’Majesty Allen down and found no weapons. The officer asked Destiny Allen if she wanted to sit in the patrol vehicle and she said she did. Y’Majesty Allen then yelled to his sister and told her to get out of the patrol vehicle. She obeyed her brother and went back to her brother’s car. At that point, the task force officers left and contacted Ward County Deputy State’s Attorney Todd Schwarz, who told them to arrest Destiny Allen for maintaining a drug house.

A Minot police officer then arrived at the Auditorium and ran a check for outstanding warrants on Y’Majesty Allen. The officer discovered he had an outstanding warrant for driving with a suspended driver’s license.

The Allens had returned to the residence and Y’Majesty Allen was arrested on the outstanding warrant for the suspended license as he was moving his car so a UHaul trailer could be moved closer to the door. Destiny Allen tried to record her brother’s arrest with her cell phone and then was placed under arrest herself.
