Hailee Jacobs, Minot, receives deferred sentence, probation, for leasing apartment where drug deals took place

Hailee Anne Jacobs, 29, Minot, was given a deferred sentence and two years of supervised probation on Thursday for leasing an apartment where drug deals took place . She received a deferred sentence and 360 days of supervised probation for being in possession of cocaine.

Jacobs entered Alford pleas to maintaining a property for the use, storage, or sale of controlled substances, a Class C felony, and possession of cocaine, a Class A misdemeanor. The state dropped a Class B felony charge of intent to deliver marijuana, a Class C felony possession of drug paraphernalia, and a Class B misdemeanor charge of possession of marijuana against Jacobs.

Jacobs’ then boyfriend, Jonathan Odswand Simmons, 28, was living with her in Apartment 205 in the building at 805 18th Avenue SE on May 1 when the Ward County Narcotics Task Force raided the apartment. Jacobs had signed the lease and only she and her child were supposed to be living there. According to court documents, a search of the residence turned up a glass jar with marijuana residue, a plastic bag containing approximately 20 grams of marijuana, a plastic bag containing 0.94 grams of cocaine, an electronic scale with suspected marijuana and cocaine residue, a small baggie of marijuana, assorted drug paraphernalia, a cell phone belonging to Simmons, $1,600 in U.S. currency in a large men’s jumpsuit pocket, four money orders and a Money Gram receipt. While the task force was there, someone came to the door hoping to purchase marijuana from Simmons. An officer testified at the sentencing hearing on Thursday that most of the items found were in the master bedroom shared by Jacobs and Simmons and they were either in plain view or easily discovered by searching.

Simmons pleaded guilty on July 11 to possession with intent to deliver marijuana, a B felony, C felony possession of cocaine, and unlawful possession of a firearm, a C felony. Judge Richard Hagar gave him a deferred sentence on the intent to deliver marijuana charge and two years of supervised probation and was sentenced to a year in jail on the other two felonies, all suspended but the 17 days he already served, and two years of supervised probation. The sentences are concurrent.

A deferred sentence means Jacobs’ felony and misdemeanor charges and the intent to deliver marijuana charge against Simmons will be dismissed if they successfully complete probation.

Both were also ordered to pay court costs.

On Thursday, during Jacobs’ change of plea hearing, Judge Doug Mattson asked her what was going on with her.

Jacobs told the judge she does not have a substance abuse problem and a chemical dependency evaluation showed no issues she needs to address.

“I didn’t believe he was dealing drugs,” said Jacobs, who said these charges do not represent her character. “… I was hanging out with the wrong people.”

“So what you’re telling me is you’re an enabler for people dealing drugs,” Mattson said.

Mattson told Jacobs that she could very likely have trouble qualifying for public housing in the next few years, which he said is an appropriate consequence. Jacobs had said at a previous hearing that she was evicted from her Minot Housing Authority subsidized apartment after the raid.

Mattson said Jacobs’ association with a drug dealer and the drug activity in her home are a public safety issue.

“That isn’t good for the public, it’s not good for the child, and it’s not good for you,” he admonished Jacobs, advising her to think carefully about her future.
