Garrett Smith, Halliday, sentenced for beating pregnant ex-girlfriend

Garrett Shawn Smith, 26, Halliday, originally charged with Class C felony aggravated assault for assaulting his pregnant ex-girlfriend in Minot in May, pleaded guilty on Friday to Class A misdemeanor simple assault.

Court records show that Smith was sentenced to 360 days in jail, all suspended but the 52 days he has already served, and 18 months supervised probation. Smith was also ordered to complete a class for domestic violence offenders, to have no contact with his ex-girlfriend, and to pay $325 in court costs.

According to a probable cause affidavit filed with the court, the woman reported the assault three months later at her doctor’s urging. She told police that Smith came home drunk, called her names, punched holes in the wall, and pushed her into a chair, causing her to fall into the laundry room. The metal chair cut into her shin and made her bleed. While she was on the ground, Smith punched her in the jaw, her eyes, and on the top of her head. She lost consciousness. Her son witnessed the assault.
