Kirk Wilkie, Devils Lake, sentenced for stealing vehicle, fleeing police

Kirk Monte Wilkie, 29, Devils Lake, was sentenced Thursday to one year in jail, all suspended but the 39 days he has already served, and three years of supervised probation for stealing a Jeep Patriot from the M&H Gas Station in Minot on Nov. 5 and fleeing from police at speeds up to 112 mph, heading towards Velva.

Wilkie pleaded guilty to Class B felony theft of property, Class C felony fleeing a police officer and to Class B misdemeanor actual physical control. The state dropped two other charges of Class B misdemeanor reckless driving and Class B misdemeanor driving under suspension under the terms of a plea deal.

Judge Richard Hagar also ordered Wilkie to pay restitution still to be determined. The vehicle was totaled and damages could amount to about $19,000. Wilkie must also pay $775 in court costs for the theft and $500 in fines for the actual physical control. The sentences are concurrent.

The felonies will be deemed Class A misdemeanors if he successfully completes probation.

Wilkie must also obtain a chemical dependency evaluation.

Ward County Assistant State’s Attorney Ashlei Neufeld told Hagar that the state guidelines suggest presumptive probation since Wilkie’s past criminal record contained only misdemeanors.

However, the owner of the stolen vehicle testified that she doesn’t agree with the sentence and thinks he should have to serve more time in jail. She told Wilkie that she had worked for over 20 years for a new vehicle and she felt sick when she heard how he had damaged it while fleeing from police. She also felt violated.

Wilkie also has arrest warrants in Pierce County on charges of theft of property and simple assault – domestic violence, court records show.
