Each bid must be accompanied by a
bidder’s bond in a sum equal to 5%
of the full amount of the bid execut-
ed by the bidder as principal and by
a surety, conditioned that if the prin-
cipal’s bid is accepted and a con-
tract is awarded to the principal, the
principal, within ten (10) days after
the notice of the award, shall exe-
cute a contract in accordance with
the terms of the bid and the bid
bond, and any conditions of the City
of Tioga, as required by law. A coun-
tersignature of a bid bond is not re-
quired. If the City of Tioga elects to
award a contract to the lowest
responsible bidder, and the lowest
responsible bidder does not execute
a contract within ten (10) days, the
bidder’s bond will be forfeited to the
City of Tioga, and the City of Tioga
may award the project to the next
lowest responsible bidder. Each
bidder must possess a valid North
Dakota contractor’s license for the
full amount of their bid, as required
by N.D.C.C. § 43-07-7. Each bidder
MUST enclose a copy of their
Contractor’s License or Certificate of
Renewal, issued by the North Dako-
ta Secretary of State, and each
license must be valid and dated at
least 10 days prior to the date set for
bid opening, as required under
N.D.C.C. § 43-07-12.

Each bid shall be accompanied by a
separate envelope containing a Bid
Bond in a sum equal to five percent
(5%) of the maximum bid price,
executed by the Bidder as principal
and by a surety company authorized
to do business in the State of North
Dakota, payable to the Mohall
Municipal Airport Authority,
conditioned that if the principal’s bid
be accepted and the contract
awarded to him, he, within ten (10)
days after Notice of Award has been
executed, will execute and effect a
contract in accordance with the
terms of his bid and a contractor’s
bond as required by law and
regulations and determinations of
the governing board. The bid
security of the two lowest bidders
will be retained until the Notice of
Award has been executed, but no
longer than 60 days. The bid
security is a guarantee that the
bidder will enter into contract for
work described in the Proposal.
The Contractor shall also enclose
within the Bid Bond envelope a copy
of the bidder’s North Dakota
Contractor’s License or a copy of
their latest renewal certificate issued
by the Secretary of State as per
North Dakota Century Code
43-07-07 and 43-07-12. Any bid not
containing this document shall not
be acceptable and shall be returned
to the Bidder.
The successful Bidder will be
required to furnish a Contract
Performance Bond and Payment
Bond in the full amount of the
Contract.
The Mohall Municipal Airport
Authority, Mohall, North Dakota,
reserves the right to hold all bids for
a period of 60 days after the date
fixed for the opening thereof to reject
any and all bids and waive defects
and to accept any bids should it be
deemed for the public good and also
reserves the right to reject the bid of
any party who has been delinquent
or unfaithful in the performance of
any former contract to the Owner.
The successful Bidder will have to
obtain a statement from the Office of
the State Tax Commissioner
showing that all taxes due and ow-
ing to the State of North Dakota
have paid before the contract can be
executed.
The Mohall Municipal Airport
Authority, in accordance with the
provisions of Title VI of the Civil
Rights Act of 1964 (78 Stat.252, 42
U.S.C. §§ 2000d to 2000d-4) and
the Regulations, hereby notifies all
bidders or offerors that it will
affirmatively ensure that any
contract entered into pursuant to this
advertisement, disadvantaged
business enterprises will be afforded
full and fair opportunity to submit
bids in response to this invitation
and will not be discriminated against
on the grounds of race, color, or
national origin in consideration for an
award.
The requirements of 49 CFR part 26
apply to this contract. It is the policy
of the Mohall Municipal Airport
Authority to practice nondiscrimina-
tion based on race, color, sex, or
national origin in the award or
performance of this contract. The
Owner encourages participation by
all firms qualifying under this
solicitation regardless of business
size or ownership.
The Owner’s award of this contract
is conditioned upon Bidder or
Offeror satisfying the good faith
effort requirements of 49 CFR
§26.53. The successful Bidder or
Offeror must provide written
confirmation of participation from
each of the DBE firms the Bidder or
Offeror lists in its commitment within
five days after bid opening. As a
condition of bid responsiveness, the
Bidder or Offeror must submit the
following information with their
proposal on the forms provided
herein:
1. The names and addresses of
Disadvantaged Business Enterprise
(DBE) firms that will participate in
the contract;
2. A description of the work that
each DBE firm will perform;
3. The dollar amount of the

bids will be received for the “Hwy 52
Water Main Replacement” Project
#B20-00-037, McHenry and Ward
Counties, ND. Bids will be received
by Teresa Sundsbak, at the office of
the North Prairie Regional Water

2022 and then at said office all bids
properly submitted will be publicly

Each bid will be submitted on the
basis of a cash payment for work. It
will be enclosed in a sealed en-
velope addressed to the

nated that the bid is for “Hwy 52 Wa-
ter Main Replacement Project
B20-00-037.” The bid shall be ac-
companied by a Bidder’s Bond in a
separate envelope in the amount of
five percent (5%) of the full amount
of the bid, executed by the Bidder as
Principal and by a Surety Company
authorized to do business in ND. If
the Principal’s bid is accepted by the
North Prairie Regional Water District
and the contract awarded, the princi-
pal, within ten (10) days after the
Notice of Award, will be required to
execute and effect a contract in ac-
cordance with the terms of the
principal’s bid and any requirements
and conditions of the OWNER.
Bidders on this work will be required
to comply with Title 40 CFR Part 33
– Participation by Disadvantaged
Business Enterprises in the United
States Environmental Protection
Agency Programs. The require-
ments for bidders and contractors
under this regulation concern utiliza-
tion of Minority Business Enterprises
(MBE), Women’s Business Enter-
prises (WBE), and Small Business
Enterprises (SBE) and are explained
in the specifications. The goal for
MBE is 2% of the total dollar value
of the project. The goal for WBE is
3% of the total dollar value of the
project. To demonstrate a good faith
effort to comply, bidders must in-
clude the MBE/WBE subcontractor
solicitation form in the bid package.
Bidders on this work will be required
to comply with the President’s Exe-
cutive Order No. 11246, as amend-
ed. The requirements for bidders
and contractors under this order are
explained in the specifications.
Bidders on this work will be required
to comply with American Iron and
Steel requirements of the Consoli-
dated Appropriations Act, 2014. The
requirements for bidders and con-
tractors under this regulation are ex-
plained in the specifications. A
Contractor’s Bond, as required by
Section 48-01.2-10 of the North
Dakota Century Code, shall be in-
cluded with the executed Contract
Documents. The Bid Security shall
be as required in Section 48-01.2-05
of the North Dakota Century Code.
All bidders must be licensed for the
highest amount of their bids, as re-
quired by Section 43-07-05 of the
North Dakota Century Code and a
copy of the license or certificate of
renewal thereof issued shall be en-
closed in the required bid bond en-
velope. No bid will be read or con-
sidered which does not fully comply
with the above provisions as to Bond
and Licenses, and any deficient bid
submitted will be resealed and re-
turned to the Bidder immediately.
The OWNER retains the right to re-
ject any or all of the bids submitted
and to waive any informality in any
bid and to hold all bids for a period
not to exceed thirty (30) days from
said date of opening and to hold the
three low bids and bid securities for
a period not to exceed sixty (60)
days from said date of bid opening.
The work on the improvements is to
commence upon a date to be speci-
fied by the OWNER, notice of which
will be given to the successful bidder
ten (10) days in advance of the start
of construction. The Contractor will
be required to commence construc-
tion, and in an approved sequence,
complete the project by November

the costs and expenses of sale, will
be sold subject to redemption as
provided by law as one parcel of
land at public auction, subject to the
lien for unpaid real estate taxes and
assessments of Ward County, North
Dakota, and easements and restric-
tions of record, to the highest bidder
for cash under the direction of the
Sheriff of Ward County, North Dako-
ta, at the main entrance of the Ward

PUBLIC NOTICE
The North Dakota Department of
Commerce, Division of Community
Services, will hold a public hearing
on March 25, 2022, at 11 a.m. CST,
to gather input on affordable hous-
ing, special needs housing, home-
less needs, public facility needs,
economic development needs, and
priority needs in the state. Com-
ments will be used to develop the
2022 Annual Action Plan.
The Annual Action Plan includes the
state’s Community Development
Block Grant (CDBG) and the Emer-
gency Solutions Grant (ESG) pro-
gram distribution plans. Currently,
the state estimates the 2022 funding
to be $4,023,000 for CDBG and
$480,000 for ESG. Suggestions are
needed on how to prioritize the use
of these funds. The CDBG funding
must be used for activities that pri-
marily benefit low- and
moderate-income persons (LMI), al-
leviate slum and blight, or address a
condition that threatens life and
death. The ESG funding must be
used for providing services to the
homeless and those at risk of
becoming homeless.
