These notices shall satisfy two
separate but related procedural re-
quirements for activities to be under-
taken by the City of Minot.
REQUEST FOR THE RELEASE
OF FUNDS
On or about March 27, 2020, the
City of Minot will submit a request to
the U.S. Department of Housing and
Urban Development (HUD) Region
VIII for the release of 2011 Com-
munity Development Block Grant
Disaster Recovery (CDBG-DR)
funds, under Title I of the Housing
and Community Development Act of
1974, as amended, to undertake a
project known as City of Minot
CDBG-DR Program: City of Minot
Buyout Program, for the purpose of
allowing property owners to move
out of harm’s way and the threat of
flooding and enable the City to retain
the parcels as open space or for
flood control measures. The total al-
location will be $300,000, with
CDBG-DR funds totaling $300,000.
The proposed project would involve
buying properties located within the
Flood Inundation Area, delineated
by the City as the area where the
heaviest flooding and damage oc-
curred during the June 2011 severe
flooding event. Such properties
would include single-family
residences, multi-family residences,
mobile homes, mobile home pads,
religious establishments and com-
mercial establishments. Some
structures would include both
residential and commercial uses and
some residences may be owner- or
tenant-occupied. Once the lot is
bought by the City, all existing struc-
tures will be removed and the parcel
would remain as open space or be
used for flood control measures,
specifically a flood levee system.
The Responsible Entity (RE), City of
Minot, has determined that this pro-
ject will be reviewed in a tiered en-
vironmental assessment. The
specific addresses of properties to
be bought, with one exception (818
6th Avenue NW), are not yet known
at this time since the property iden-
tification process is ongoing. There-
fore, under 24 CFR 58.15 (Tiering)
and 24 CFR 58.32 (Project Aggrega-
tion), the City of Minot will utilize a
tiered approach. Therefore, under 24
CFR 58.15 (Tiering) and 24 CFR
58.32 (Project Aggregation), the City
of Minot will use a tiered approach.
Applying the tiering rule provides the
City the ability to aggregate work on
individual project sites into
categories of activities having similar
geographic and/or functional en-
vironmental attributes. The “Broad
Review” or “Tier 1″ review ad-
dresses the specific environmental
factors for which compliance has
been documented regardless of
specific site locations. It allows the
process to not repeat the same com-
pliance factors on a site-specific
basis, once all project activity sites
are known. “Site-specific” or “Tier 2”
review will consist of documentation
of site-specific environmental issues
requiring individual evaluation or
agency consultation. No activities
associated with the proposed project
will occur until both levels of environ-
mental review have been completed
and the proposed work has been
found to be in compliance. Thus, the
EA is considered a two-step, tiered
process, per 24 CFR 58.15. The
site-specific review for 818 6th Ave-
nue NW was incorporated into the
Broad Review.
FINDING OF NO SIGNIFICANT
IMPACT
The City of Minot has determined
that the project will have no signifi-
cant impact on the human environ-
ment. Therefore, an Environmental
Impact Statement under the National
Environmental Policy Act of 1969
(NEPA is not required. Additional
project information is contained in
the Tiered Environmental Review
Record (ERR) on file at the City of
Minot, 515 2nd Avenue SW, Minot,
North Dakota, 58702-5006, and may
be examined or copied weekdays
9:00 A.M. to 5:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency
may submit written comments on
the ERR to the City of Minot, P.O.
Box 5006, Minot, North Dakota,
58702-5006. All comments received
by March 27, 2020 will be con-
sidered by the City of Minot prior to
authorizing submission of a request
for release of funds. Comments
should specify which Notice they are
addressing.
RELEASE OF FUNDS
The City of Minot certifies to HUD
Region VIII that Mr. Shaun Sipma in
his capacity as Mayor consents to
accept the jurisdiction of the Federal
Courts if an action is brought to en-
force responsibilities in relation to
the environmental review process
and that these responsibilities have
been satisfied. HUD Region VIII’s
approval of the certification satisfies
its responsibilities under NEPA and
related laws and authorities, and al-
lows the City of Minot to use Pro-
gram funds.
OBJECTIONS TO RELEASE OF
FUNDS
HUD Region VIII will accept objec-
tions to its release of funds and the
City of Minot’s certification for a
period of 15 days following the anti-
cipated submission date or its actual
receipt of the request (whichever is
later) only if they are made on one of
the following bases: (a) the certifica-
tion was not executed by the Certify-
ing Officer of the City of Minot (b)
the City of Minot has omitted a step
or failed to make a decision or find-
ing required by HUD regulations at
24 CFR Part 58; (c) the grant reci-
pient or other participants in the
development process have commit-
ted funds, incurred costs or under-
taken activities not authorized by 24
CFR Part 58 before the approval of
a release of funds by HUD Region
VIII; or (d) another Federal agency,
acting pursuant to 40 CFR Part
1504, has submitted a written finding
that the project is unsatisfactory
from the standpoint of environmental
quality. Objections must be
prepared and submitted in accor-
dance with the required procedures
(24 CFR Part 58, Sec. 58.76) and
shall be addressed to U.S. Depart-
ment of Housing and Urban
Development, Region VIII Office,
8ADE, 1670 Broadway Street,
Denver, Colorado 80202-4801. Po-
tential objectors should contact HUD
to verify the actual last day of the
objection period.

notice. The City of Minot is currently
pursuing the aid of the United States
Air Force Reserve in Vector Control
for fiscal year 2020 and 2021. The
proposal is for the Department of
Defense (Innovative Readiness
Training Program) to perform arthro-
pod borne disease control training
through the aerial application of pes-
ticides. There is no funding for these
operations without the assistance of
the USAFR unit. To fulfill the
non-competitive requirements of the
Department of Defense, this notice
