Minot, ND. A “Drop Box” will be es-
tablished for Bidder access. The
Contract Documents will be on file
and may be examined at the Office
of Anderson Wade & Whitty PC, Ar-
chitects, Minot, North Dakota and
the following Builders Exchanges:
Minot, Fargo, Grand Forks,
Bismarck-Mandan and Construction
Plans Exchange, North Dakota; St.
Paul, Minneapolis, Construction
Market Data and Dodge-SCAN, Min-
nesota; Construction Industry
Center, and Sioux Falls Builders Ex-
change, South Dakota. Each bid (in
duplicate) must be accompanied by
a separate envelope, (attached to
the bid envelope) containing a Bid
Bond equal to five percent (5%) of
the amount of the Bid naming the
Minot Public Schools as Obligee.
The Contractor shall also enclose
within the Bid Bond envelope a copy
of the Bidder’s North Dakota
contractor’s License or a copy of
their latest Renewal certificate is-
sued by the Secretary of State as
per North Dakota Century Code
43-07-12. All Contractors who sub-
mit Bids must hold a North Dakota
Contractors License in the highest
amount of their Bids and such
license must have been in effect at
least ten (10) days prior to the date
of the Bid opening. Any Bid not con-
taining these documents shall not be
acceptable and shall be returned to
the Bidder unopened. The Owner
reserves the right to reject any or all
bids and to waive any informality in
bidding. The successful bidder will
be required to furnish a Payment
Bond, Performance Bond, Insurance
coverage and other requirements
stipulated in the Specifications. No
Bidder may withdraw his Bid within
30 days of the actual date of the
opening. DAVIS-BACON ACT AND
EQUAL EMPLOYMENT OPPOR-
TUNITY: The Contractor shall com-
ply with all Davis-Bacon Act and
Equal Opportunity Requirements as
set forth in the Contractual Require-

Copies of the bidding documents are

change in Bismarck; Builders Ex-

Dakota, Minnesota Builders Ex-

and the Owner.
Each bid shall be submitted in dupli-
cate copy on the forms provided by
the Owner and enclosed in a sealed
opaque envelope upon which there
is disclosed the necessary informa-
tion as required by the Supplemen-
tary Instructions to Bidders.
Each bid shall be accompanied by a
separate sealed opaque envelope
containing a bidder’s bond made
payable to The Adjutant General,
State of North Dakota, and executed
by the bidder as principle and by a
surety company authorized to do
business in North Dakota, in a sum
equal to five percent (5%) of the
bidder’s highest total bid combina-
tion, including all add alternates to
the bid items; conditioned that if the
bidder’s proposal be accepted and
the contract awarded to him, he
within ten (10) days after notice of
such award, will effect and execute
a contract in accordance with the
terms of his bid and a contractor’s
bond as required by law and the re-
gulations and determinations of the
Owner. AIA Document A310, Bid
Bond, is provided in the project
manual and should be used to exe-
cute the bid guarantee.
In compliance with Section 43-07-12
of the North Dakota Century Code,
each contractor submitting a bid
must have a copy of his North Dako-
ta Contractor’s License or certificate
of renewal thereof issued by the
Secretary of State enclosed in the
bid bond envelope; must be licensed
for the highest amount of his total
bid combination including add alter-
nates; and such license must have
been in effect at least ten (10) days
prior to the date of the bid opening.
No bid will be read or considered
which does not fully comply with the
provisions herein as to bid bond and
contractor license, and any deficient
bid submitted will be resealed and
returned to the bidder immediately.
The Owner reserves the right to hold
all legitimate bids for a period of thir-
ty (30) days after the date fixed for
the opening thereof. It is the intent
of the Owner to award a contract to
the lowest and best bidder. The
Owner further reserves the right to
reject any and all bids and to waive
irregularities, and shall incur no legal
liability for the State for the payment
of any monies until the contract is
awarded and approved by the prop-
er authorities.
In compliance with Section
48-01.2-10 of the North Dakota Cen-
tury Code, the successful bidder
shall be required to furnish payment
and performance bonds covering the
faithful performance of the Contract
and the payment of all obligations
thereunder, and all additional obliga-
tions required by the laws of the
State of North Dakota. Each bond
shall be in an amount equal to the
full contract sum.

The Fort Berthold Housing Authority
is soliciting proposals for the com-
pletion of the FY 2019 audit,
(10-01-2018 to 9-30-2019) for the
Fort Berthold Housing Authority
grants and funds administered under
contracts with the United States
Department of Housing and Urban
Development (including all grants
administered under the Native
American Housing Assistance and
Self-Determination Act of 1996 as
the Tribally Designated Housing En-
tity of the Three Affiliated Tribes),
and all other accounts of the Fort
Berthold Housing Authority including
investment funds and retirement
funds. All propsals must include the
following:
¯Total Proposed Cost and a break-
down into line items of the costs of
services performed, including hourly
or weekly fees and if applicable a
maximum limitation on fees.
¯Certification by the Three Affiliated
Tribes Tribal Employment Rights Of-
fice that the business is an
Indian-owned and operated busi-
ness if applicable.
¯Proposed schedule for the comple-
tion of audits to be performed.
¯Any additional information that
would assist the Fort Berthold Hous-
ing Authority in determining the ex-
perience and qualifications of the
firm submitting a proposal to perform
the audits.
¯Any limitation or special conditions
on the performance of audit pro-
posed by the auditing firm.
