A 34-year-old Douglas man will spend about 16 months in prison for driving drunk on May 12, 2017, and injuring the passengers in his car. One child passenger had to be airlifted to Fargo with internal injuries following the accident.
Edwin Emery Zuck pleaded guilty to the Class C felony criminal vehicular injury charge on Thursday in district court in Minot. A Class A misdemeanor charge of aggravated reckless driving was dismissed.
Court records show that Judge Richard Hagar sentenced Zuck to a total of three years in prison, with a requirement that he first serve 16 months, and three years of supervised probation.
Zuck will also be required to obtain a chemical dependency evaluation, to pay $5,890.35 in restitution and $1,100 in court costs.
According to court records, Zuck was driving at 68 miles per hour in a 55 mile per hour zone on a gravel road. He made a turn onto 149th Avenue SW and crashed and rolled the vehicle. When authorities arrived, Zuck was standing by the vehicle and smelled of beer. There were several empty beer cans and an open vodka bottle in the vehicle. A woman and two children, who were born in 2010 and 2011, were all thrown from the vehicle during the crash.
Zuck had a breath alcohol content reading of .144.
