Travis Eugene Yoney, 44, Minot, pleaded not guilty Thursday to charges that he tried to shoot and kill a one-time confidential informant whose actions reportedly resulted in Yoney's Class B felony conviction last year for delivery of marijuana.
Yoney, drunk at the time, allegedly went over to the other man's trailer with a rifle and fired one round from outside the trailer that lodged inside the trailer near an entertainment set, then forced his way into the home and fired a second round that lodged in the kitchen area.
The other man tackled Yoney and managed to subdue him until police arrived. The other man's girlfriend and their young child were in the trailer at the time.
Yoney is charged with Class A felony attempted murder, Class B felony burglary, Class C felony terrorizing, Class C felony reckless endangerment, Class C felony prohibited possession of a firearm by a felon, and Class A misdemeanor violation of an order prohibiting contact.
Yoney's defense attorney, Benjamin Migdal, argued at the probable cause hearing Thursday that the state had not met its burden of proof on the attempted murder charge and Yoney might have just intended to scare and intimidate the residents of the trailer. Judge Gary Lee, who pointed out that Migdal had just conceded Yoney's guilt on the terrorizing charge, said he found probable cause for all of the charges, including attempted murder.
The next hearing in the case is a pretrial conference scheduled for Dec. 5.
