Kraus-Anderson Construction
Company is presently soliciting
competitive Lump Sum Bids for the
Minot Area Workforce Academy
project. This portion of the project
consists of constructing a new
training facility addition along with
renovating an existing one story
building. The scope of work for
these buildings includes demolition,
concrete and masonry, steel supply
and erection, finishes, mechanical,
electrical, and earthwork.
Sealed bids will be received until
1:00 PM local time on Thursday May
5th, 2022 at the address noted
below. Bids received after this time
will not be considered. Bids will be
opened at the Minot Public Schools
District Office and publicly read
aloud.
Kraus-Anderson Construction
Company is the only authorized
agent to receive bids.

The complete bid form shall be
without alterations, additions, or
erasures. All bids shall be on a lump
sum basis. No bid may be withdrawn

or all bids and to waive any irregu-
larities in bids.

NOTICE IS HEREBY GIVEN that
the Minot Area Chamber EDC will
receive sealed Bids for the construc-
tion of MINOT SOUTH INTERMO-
DAL EXPANSION, at the office of
Ackerman-Estvold, 1907 17th Street
SE, Minot, North Dakota, until 11:00
AM Wednesday, April 27, 2022, at
which time all Bids will be publicly
opened and read aloud.
All Bids must be submitted, and all
work shall be done, in full and strict
compliance with:
1. The Plans & Contract Documents
for this project;
2. Any Special Conditions for this
project;
3. The 2018 BNSF Guidelines for In-
dustry Track Projects.

Generally, the Work covered by the
Plans and Specifications for Minot
South Intermodal Expansion con-
sists of the materials, labor, tools,
and equipment required for the con-
struction of railroad track improve-
ments and gravel access roads. The
Work includes approximately 4,300
TF of 136-lb jointed track. The Work
shall also include 2 track turnouts, 1
derail, a water meter vault and 8″
water service, about 12,000 Ton of
aggregate materials used for track
subballast and access roads, CMP
extensions of 18“, 24”, and 36″ cul-
verts, new 30″ RCP pipe, 25 Ton of
asphalt pavement, and other in-
cidentals as necessary to complete
the project. Details of the construc-
tion are included in the Drawings
and Project Manual.
All Bids are to be submitted on the
basis of cash payment for the Work
and Materials necessary to complete
the project. Each bid must be ac-
companied by a separate envelope
containing the contractor’s license
and bid security. The bid security
must be in a sum equal to five per-
cent of the full amount of the bid and
must be in the form of a bidder’s
bond. A bidder’s bond must be exe-
cuted by the bidder as principal and
by a surety, conditioned that if the
principal’s bid is accepted and the
contract awarded to the principal,
the principal, within ten days after
notice of the award, shall execute a
contract in accordance with the
terms of the bid and the bid bond
and any condition of the governing
body. A countersignature of a bid
bond is not required under this sec-
tion. If a successful bidder does not
execute a contract within the ten
days allowed, the bidder’s bond
must be forfeited to the Owner and
the project awarded to the next
lowest responsible bidder. Bidders
must be licensed for the full amount
of the bid as required by section
43-07-12 of the North Dakota Centu-
ry Code.
No Bid may be read or considered if
it does not fully comply with the
requirements of Section 48-01.2-05
of the North Dakota Century Code.
The Owner reserves the right to hold
all Bids for 30 days, to reject any or
all Bids, to waive any informality or
irregularity in any Bid, to accept the
Bid deemed in the best interest of
the Owner, and to rebid the project
until a satisfactory bid is received.
There shall be endorsed upon the
outside of the envelope containing
the Bid, the following:
1. “Minot Area Chamber EDC, Minot
South Intermodal Expansion”
2. The name of the person, firm, cor-
poration, or joint venture submitting
the Bid.
3. The Bidder’s Contractor’s License
or Contractor’s License Renewal
Number.
4. Acknowledgement of the Adden-
da, if any.
Any deficient Bid received will be
resealed and returned to the Bidder
immediately.
All work shall be substantially com-
plete by July 15, 2022. All work shall
be completed and ready for final
payment in accordance with the
General Conditions by August 15,
2022.
Should the Contractor fail to com-
plete its obligations under the Con-
tract within the time required herein
or within such extra time as may
have been granted by formal exten-
sions of time approved by the Own-
er, there will be deducted from any
amount due to the Contractor the
sum of $1,000 per day for each and
every calendar day that the comple-
tion of the Work is delayed. The
Contractor and his Surety will be li-
able for any excess. Such payment
will be as and for liquidated dam-
ages and not as a penalty.

COMMENT PERIOD
The North Dakota Department of
Commerce, Division of Community
Services and North Dakota Housing
Finance Agency announce the avai-
lability of the state’s 2022 Annual
Action Plan for public review and
comment.
The Action Plan serves as the
state’s application to the U.S.
Department of Housing and Urban
Development for the Community
Development Block Grant, HOME
Investment Partnerships, National
Housing Trust Fund and Emergency
Solutions Grants programs.
The Action Plan describes how the
funds from each program will be dis-
tributed during the 2022 program
year, which is scheduled to begin on
July 1, 2022. Funds are expected to
be received on or about August 1,
2022. All allocation amounts in the
2022 Plan are currently estimated.
The Action Plan will be available on-
line at ndgov.link/ConsolidatedPlan
beginning April 29th. Written com-

School Annexation Hearing
Notice is given that a public hearing
will be held by the Ward County
School District Reorganization Com-
mittee, Wednesday, April 27th at
12:00 PM in the Commissioners’
Chambers, Ward County Adminis-
tration Building, Minot, North Dako-
ta, for the purpose of considering a
petition for annexing a territory to
Minot School District from the South
Prairie School District. Both School
Districts are located primarily in
Ward County.
The Petition describes the territory

Ward County Home Rule
Charter Article No. 2-G
The Ward County Commission
passed the following updated home
rule charter language via 2nd read-
ing on April 5th, 2022. The amend-
ed language will be proposed to
voters on the June 14th, 2022 ballot.
Shall the Ward County Home Rule
Charter Article No. 2-G be amended
as follows:
Article 2-G. To provide for zoning,
planning and subdivision of public or
private property within Ward County
limits outside of the zoning authority
of any city and not inconsistent with
established zoning regulations of
organized townships. The county
shall not have the authority to
require additional dedication or
donation of right-of-way abutting
areas of existing right-of-ways.
Additional acquired right-of-ways
shall be pursuant to North Dakota
statutory procedures.
