Bids for the construction of the

Mouse River Enhanced Flood Pro-

tection Project Phase BU-1E Bur-

lington Brunelle Home Raise at the

office of Ackerman-Estvold, 1907

17th Street SE, Minot, North Dakota,

58701, until 11:00 AM CDT, Mon-

day, May 2, 2022, at which time all

Bids will be publicly opened and

read aloud. All Bids must be submit-

ted, and all work shall be done, in

full and strict compliance with the

Plans and Technical Specifications

general, the Work included in the

Project includes the labor, materials,

tools and equipment required to re-

move a residential home from its

foundation, demolish existing foun-

dation, bring fill material to raise lot,

construct a residential foundation,

install residential services, move a

residential house back onto the

foundation, and other items as fully

depicted in the Drawings and Techn-

ical Specifications. All Bids are to be

submitted on the basis of cash pay-

ment for the Work and are to be en-

closed in a sealed envelope ad-

dressed tot the undersigned Chair-

man, accompanied by a separate

envelope containing the contractor’s

license and bid security. The bid

security must be in a sum equal to

five percent (5%) of the full amount

of the Bid and must in the form of a

bidder’s bond. A bidder’s bond must

be executed by the bidder as princi-

pal and by a surety, conditioned that

if the principal’s bid is accepted and

the contract awarded to the princi-

pal, the principal, within ten days

after notice of the award, shall exe-

cute a contract in accordance with

the terms of the Bid and the bid

bond and any condition of the

governing body and the project

awarded to the next lowest responsi-

ble bidder. The bidder must be

licensed for the full amount of the bis

as required by Section 43-07-12 of

the North Dakota Century Code.

The outside of the sealed envelope

containing the bid and other required

items shall be endorsed with the fol-

lowing verbiage:

poration, or joint venture submitting

No bid may be read or considered if

it does not fully comply with the re-

quirements of Section 48-01.2-05 of

the North Dakota Century Code. Any

deficient Bid received will be

resealed and returned to the Bidder

immediately. The Owner reserves

the right to hold all bids for 30 days,

to reject any or all Bids and to waive

any informality or irregularity in any

Bid and to accept the Bid deemed in

the best interest of the Owner. The

Owner reserves the right to rebid the

project until a satisfactory Bid is re-

ceived. The work shall be substan-

tially complete by August 31st, 2022.

All work shall be complete and ready

for final payment in accordance with

the General Conditions by Sep-

tember 30, 2022. Should the Con-

tractor fail to complete its obligations

under the Contract within the time

required herein or within such extra

time as may have been granted by

formal extensions of time approved

by the Owner, there will be deducted

from any amount due to the Con-

tractor the sum of $1,500.00 per day

for each and every calendar day that

the Work is delayed. The Contractor

and his Surety will be liable for any

excess. Such payment will be as

and for liquidated damages and not

as a penalty.

MINOT CITY COUNCIL –

SCHEDULED MEETING –

March 21, 2022 AT 5:30 P.M.

Mayor Sipma presiding and led the

City Council in the Pledge of Allegi-

ance. Alderwoman Olson moved the

City Council confirm the following

mayoral appointments:

1.Vicki Summerfield to replace Mike

Rysted on the Minot Commission on

Aging Board of Directors with a term

to expire March of 2025.

2.Katelynn Albers to replace Jay

Wahlund on the Minot Housing Au-

thority Board of Commissioners with

a term to expire December of 2026.

Motion seconded by Alderman Ross

and carried by the following roll call

The City Manager provided a written

update describing events and activi-

ties for various departments. Alder-

man Podrygula expressed how he

was glad to see the continuing edu-

cation Harold had been participating

in. Harold asked Lance Meyer to

speak about the City of Minot’s 1st

virtual bid opening. Lance dis-

cussed how the bids were submitted

on the Quest Bid Network. Mayor

Sipma asked Lance if he knew of

any issues the contractor had using

Quest. Lance stated that 1 or 2 of

the contractors had not used Quest

before but we able to upload bid and

had no issues. The City Council held

a public hearing on an application

from Melissa Wright, representing

Harmony Heights, LLC and ORMA,

LLC, owners, for a zoning map

amendment from “M1” Light Industri-

al to “CBD” Central Business District

and a future land use map amend-

ment from Industrial to Downtown

Mixed Use for the purpose of quali-

fying for a façade improvement

grant, which is limited to those pro-

perties in the “CBD” Central Busi-

ness District. The legal description

for the properties is Lot 1, Baker’s

Rearrangement of a portion of Lots

1, 2, 3, 11 and 12, Block 30, First

Addition to the City of Minot and Lot

2, Baker’s Rearrangement of a por-

tion of Lots 1, 2, 3, 11 and 12, Block

30, First Addition to the City of

Minot. The addresses for the pro-

perties are 12 3rd St. SE and 212 E.

Central Ave. Alderman Jantzer

motioned to close the public hearing

and approve resolution 3751 to

amend the Future Land Use Map for

the subject properties from Industrial

to Downtown Mixed Use and ap-

prove an ordinance on first reading

for a zoning map amendment form

“M-1” Light Industrial District to

“CBD” Central Business District in

alignment with the Planning Com-

mission recommendation. Motion

seconded by Alderman Ross and

carried by the following roll call vote:

none. The City Council held a public

hearing on an application from

Harold Stewart, City Manager, on

behalf of the City of Minot for a text

amendment to the Land Develop-

ment Ordinance of the City of Minot

(LDO). The proposed changes are

the product of the City’s annual

“clean-up” ordinance and primarily

focus on adding clarifying language

to bolster the respective section’s

original intent. Alderman Pitner

motioned to close the public hearing

and approve an ordinance on first

reading for a text amendment in

alignment with the Planning Com-

mission recommendation. Motion

seconded by Alderman Jantzer and

carried by the following roll call vote:

ayes: Evans, Jantzer, Olson, Pitner,

Podrygula, Ross, Sipma; nays:

none. The City Council held a public

hearing on an application by Project

Bee, applicant on behalf of City of

Minot, owner, for a zoning map

amendment from “C2” General

Commercial to “C2” General Com-

mercial and “PUD Overlay” Planned

Unit Development. The purpose for

the request surrounds a mix of hous-

ing for homeless and

low-to-moderate income families, a

commercial restaurant, office space,

and space for congregate meals.

The legal description for the property

is Outlots 4, 6 & 7 of the SW 1/4 SW

1/4 Less Parcel 1-7A. of Section 25,

Township 155 North, Range 83

West. The property is located at

1901 S Broadway. Alderwoman

Evans motioned to close the public

hearing and approve an ordinance

on first reading for a zoning map

amendment from “c2” General Com-

mercial to “C2” General Commercial

with a “PUD Overlay” Planned Unit

Development in alignment with the

Planning Commission recommenda-

tion. Motion seconded by Alder-

woman Olson and carried by the fol-

asked Dan, Public Works Director,

what was the damage to the truck

and the situation that happened in

the accident. Dan stated that the

truck was helping haul snow when

the hoist started to rise and hit the

North Broadway Bridge. There was

$30,000 to the truck and about

$65,000 for the new roll-off arm. Ald-

erwoman Olson moved the City

Council approve a budget amend-

ment on first reading in the amount

of $100,000 from cash reserves to

Landfill vehicle maintenance and

repair; and authorize Public Works

to forego bidding requirements for a

purchase of $50,000 and allow a

solicitation of quotes to shorten the

project timeline. Motion seconded by

Alderman Jantzer and carried by the

following roll call vote: ayes: Evans,

Jantzer, Olson, Pitner, Podrygula,

Ross, Sipma; nays: none. Alder-

woman Olson asked Lance Meyer,

City Engineer, to layout the timeline

for the two projects suggested in the

recommendation. Lance stated that

the staff would design both projects

in 2022, both projects would be bid

together with the bid award going to

one contractor around February of

2023, and both projects would be

completed in the 2023 construction

season. Alderwoman Olson moved

the City Council tie the 2023 Bel Air

Safe Routes to School (SRTS) and

the proposed 2024 Washington

SRTS projects and move the 2024

project up to 2023. Motion seconded

by Alderman Pitner and carried by

the following roll call vote: ayes:

Evans, Jantzer, Olson, Pitner, Po-

drygula, Ross, Sipma; nays: none.

There were no personal appear-

ances. Closed Loop Partners, an in-

vestment firm, represented by Bob

Anderson and Stephen Klemann

presented another recycling option

to the City of Minot. Bob Anderson

lead the presentation discussing the

circular economy consisting of con-

suming, collecting, processing, and

designing & manufacturing. They

were presenting the City of Minot

with the option of a localized MRF

(Materials Recovery Facility), which

is designed to empower communi-

ties and independent haulers.

Stephen Klemman discussed the

possibility of a tailored production fa-

cility for the City of Minot that would

process 4,000 – 5,000 tons per year.

He talked about how this would el-

iminate transferring, create local

jobs, Minot will maintain full control

of the program, and the facility can

be designed for expansion and

growth. He also stated that the

timeline should not be delayed by

changing to a localized MRF. Mayor

Sipma asked them about the market

for the deliverables and Bob was

able to say that now the markets are

favorable. He also wanted to know

about the prevention method for the

non-recyclable materials that will go

through the system. Bob and

Stephen were able to say that the

best Minot can do is educate the

public on what is expected in the re-

cycling. Residue costs can happen

but there is a low chance of damag-

ing the system with the materials the

system is made of. Alderwoman

Evans asked the representatives

from Closed Loop Partners about

the products that can be recycled

with this equipment. They respond-

ed by stating the City of Minot can

go up to 10 commodities with the

system that would best fit the City

now but there can be growth to that

system. Alderman Ross inquired if

Closed Loop Partners has worked

with a community the size of Minot.

They stated that the size of our com-

munity is the size they are looking to

get started into this process. Alder-

man Ross also wanted to know if the

City of Minot would be responsible

to create the relationships and Bob

just mentioned that this would be a

discussion for the City of Minot and

Closed Loop Partners to discuss.

Alderman Podrygula mentioned that

we have always been told we don’t

have the volume, market, and we

are too far from buyers. Bob

responded with saying that Closed

Loop Partners wants to break the

current model of how recycling has

been. It is important to keep the

process simple and cheap and elim-

inate some of the other process.

Alderwoman Olson was intrigued by

what was discussed tonight and en-

courage further conversations about

this. Jason Sorenson, Assistant

Public Works Director, stated that

this is newer to the industry and re-

latable to a city our size. Alderwom-

an Evans also expressed that she

would like to keep the Summer 2023

timeline. Mayor Sipma also men-

tioned that the City Council is look-

ing into doing community recognition

for teams and students this year.

Alderman Podrygula attended the

County Planning Commission meet-

ing, Minot Commission on Aging

meeting, an Area Resource Council

meeting, and an active shooter table

top discussion. Alderwoman Olson

had no committees to report on but

did attend a document review team

meeting for the new high school.

Alderwoman Evans attended the Li-

brary Board Meeting, County Plan-

ning Commission meeting, and a

Pavement Management meeting.

Mayor Sipma will report on his meet-

ing at the next meeting in the May-

oral Report but did mention that he

attended a Ward County Weed

Board meeting. Alderman Ross at-

tended a Land Ordinance meeting

and has a Zoning Committee meet-

ing coming up. Alderman Jantzer

had no committees to report on this

meeting Alderman Pitner attended

the Visit Minot Board meeting and

his Renaissance Board meeting was

canceled. There being no further

business, Alderman Ross moved the

City Council meeting be adjourned.

Mayor Tollefson called the meeting

to order at 7:00 p.m. with recital of

the pledge and roll call.

Gantzer/Dickinson MSP to approve

the agenda with revisions to the

amount of pending claims to be

paid, accepting the bank statements,

and adding the Legion Post 91

Gaming Site Authorization as an

item of new business.

Fennewald/Clark MSP to approve

the March Regular and Special

meeting minute sets as provided.

The auditor asked for member direc-

tion regarding a separate savings

account held specifically named TIF

as the balance does not match fund

or is able to transact properly. All

members agreed to have the past

minutes researched to find out why

the Tif Savings would have been

opened and bring back to the next

regular meeting. Johns/Wheeler

MSP to approve the March Financial

Reports, Payroll totals, and claims to

be paid. The bomb threat that oc-

curred at the school was brought up

resulting in plans to set up a future

table-top discussion where all agen-

cies will be invited to better prepare

for such situations. All members

agreed that an attorney backup

would not be required in case of a

personal leave. Karsten Erdman,

representing Dollar General, was

phoned into the meeting as the busi-

ness is looking to establish commer-

cial location within the City just south

of Highway 2 and was made aware

of restrictions on the desired proper-

ty. Along with that, property owner

request was submitted to the

members for consideration of

release of covenants that exist on

the subject land. Suggestion was

made to hold a public hearing to

give the community an opportunity

to speak towards the development

of Dollar General in city limits.

Gantzer/Clark MS moved to table

the property owner’s request to

release restrictive covenants affect-

ing Section 19 and 30 Township 155

North, Range 81 West of the 5th PH

in Ward County. Roll Call Vote: Ms.

Gantzer-Aye, Mr. Clark-Aye, Mr.

Dickinson-Aye, Mr. Fennewald-Aye,

Ms. Wheeler-Aye, Ms. Johns-Aye.

Motion passed unanimously. Ac-

cording to the map, 70 signs and

poles would be required to follow

minimum set standards along the

snow removal route. No action was

taken. A similar engine to the one

on the crack seal machine may work

through Keller Paving.

Johns/Gantzer MS to spend up to

$2,500.00 on an engine for the crack

seal machine detouring from having

to hire out services. Motion carried

with all ayes except for Mr. Clark.

The street sweeper also has been

out and running with some difficul-

ties being an older machine but is

cleaning the streets nicely. A cal-

lout for assistance to help a neigh-

boring city on a frozen sewer line

was reported resulting in publics

works responding, a drafted equip-

ment use agreement, and invoicing

for services. No members had

questions. In making attempt to

even out the number of member

seats up at a time for election, the

motion to accept Mr. Fennewald’s

June resignation does not allow for

his position to be listed on the up-

coming ballot as he would have had

to vacate his position 60 days prior

to the publication deadline.

Johns/Gantzer MSP to accept Mr.

Fennewald’s Ward 1 withdrawal of

June resignation. Topic of TIF Dis-

trict was requested to be on agenda

with no updates except for findings

of the original agreement establish-

ing the District. Clark/Johns MSP to

table topic of the TIF District and

setup a Special Meeting at the end

of April to review agreements and

original maps on file. Gaming appli-

cation for Devils Fire location was

presented to the members.

Dickinson/Wheeler MSP to approve

the American Legion Post 91 Gam-

ing Site Authorization renewal. Due

to results of negative feedback, the

members agreed the evergreen

trees be donated to the Park District

and the planters be pulled from the

city entrance storing them in the

gate behind the hall until future

volunteers come forward. Deputy

auditor Shaw attended and gave a

summary of the Ward County miti-

gation meeting that was held for ha-

zard planning in the community.

Zoning minutes from their March

meeting were given to the members

with recommendations.

Clark/Dickinson MS to accept Plan-

ning and Zoning’s recommendation

to allow up to 20 hens on at least 2

acres of land in the extraterritorial

area as long as they are fenced and

cooped. Roll Call Vote: Mr.

Gantzer-Aye, Ms. Johns-Aye, Ms.

Motion carried. Zoning forms to be

put into use were presented.

members agreed that blinds or cur-

tains be put on the windows inside

the hall, whichever cheaper, for

better showing of movies. Meeting
