NOTICE IS HEREBY GIVEN that
the City of Minot (Owner) is re-
questing Bids for the construction of
the following Project:City Hall Re-
taining Walls 1 & 2 – 2021 Rebid
(4398). Bids for the construction of
the Project will be received at theof-
fice of the City Clerk located at 515
Second Avenue SW (Second Floor),
Minot, North Dakota, 58702 until 19,
October 2021 at 11:00 am local
time. At that time the Bids received
will be publicly opened and read.
The Project includes the following
Work: Demolition of an existing
grouted rock slope, and installation
of a large block retaining wall (ap-
prox. 200LF), soldier pile retaining
wall with concrete or precast con-
crete façade (approx. 975LF), con-
crete valley gutters and moment
slabs, steel stairs and aluminum
guardrails, water main, asphalt
pavement, parking lot lighting, strip-
ing and landscaping. Complete digi-

bidding documents are also avail-
able at the Issuing Office – KLJ 300

chase for $100. Potential bidders

with any additional questions. Each
bid must be accompanied by a
separate envelope containing the
bid security in a sum equal to five
percent of the full amount of the bid
and must be in the form of a bidder’s
bond. A bidder’s bond must be exe-
cuted by the bidder as principal and
by a surety, conditioned that if the
principal’s bid is accepted and the
contract awarded to the principal,
the principal, within ten days after
notice of the award, shall execute a
contract in accordance with the
terms of the bid and the bid bond,
and any condition of the City of
Minot, as required by law. A counter-
signature of a bid bond is not re-
quired. If the City of Minot elects to
award a contract to the lowest
responsible bidder, and the lowest
responsible bidder does not execute
a contract within the ten days al-
lowed, the bidder’s bond must be
forfeited to the City of Minot and the
project awarded to the next lowest
responsible bidder. Each bidder
must possess a valid North Dakota
contractor’s license for the full
amount of their bid, as required by
Section 43-07-07 of the North Dako-
ta Century Code. Each bidder MUST
enclose a copy of their Contractor’s
License or Certificate of Renewal, is-
sued by the North Dakota Secretary
of State, in their bid bond envelope,
and each license must be valid and
dated at least 10 days prior to the
date set for bid opening, as required
under Section 43-07-12 of the North
Dakota Century Code. No bid may
be read or considered if it does not
fully comply with the requirements of
Section 48-01.2-05 of the North
Dakota Century Code, and any de-
ficient bid submitted will be resealed
and returned to the bidder immedi-
ately. All Bids submitted and all
Work completed must be as stipulat-
ed in the Agreement. The City of
Minot reserves the right to hold all
Bids for a period of 30 days after the
date of the bid opening, to reject any
or all Bids, and to waive any infor-
mality or irregularity in any Bid. For
all further requirements regarding
bid submittal, qualifications, pro-
cedures, and contract award, refer to
the Instructions to Bidders that are
included in the Bidding Documents.

GENERAL BID SPECIFICATIONS
City of Minot
Retail Liquor Licenses
The City of Minot is soliciting sealed
bids from interested, qualified par-
ties for four (4) retail liquor licenses.
A retail liquor license allows for the
on-sale and/or off-sale of liquor,
beer, and wine. The annual license
fee for a retail liquor license is three
thousand one hundred twenty-five
dollars ($3,125.00) per year. A
minimum bid of $100,000.00 is re-
quired. This is a new license the City
Council may issue as it deems war-
ranted by the change in population
as determined by the official 2020
United States Census. Sealed bids
must be submitted to the City Clerk’s
office at City Hall (515-2nd Avenue
SW, 2nd floor), Minot, North Dakota,
by 11:00 a.m. on Tuesday, October
26, 2021. The mailing address is:
Minot City Clerk, P.O. Box 5006,
Minot, North Dakota, 58702. Bids re-
ceived after 11:00 a.m. on October
26, 2021 will be returned unopened,
to the bidder. The Bid Opening will
occur at 11:00 am Tuesday, October
26, 2021 at the Council Chambers at
City Hall, 515 2nd Ave SW. Bidders
are welcome be present to observe
the Bid Opening. Interested persons
must meet all of the requirements of
the Minot City Ordinances and North
Dakota state law in order to be
awarded the retail liquor license.
The retail liquor license will be
awarded to the highest, qualified
bidder and is subject to the approval
of the Minot City Council. To submit
a bid for a retail liquor license, the
bidder must submit the following Bid
Materials in a sealed envelope, to
the City Clerk’s Office by 11:00 a.m.
on Tuesday, October 26, 2021:
1.A completed Bid Form;
a.Each bid must be on the form pro-
vided by the City of Minot with these
General Bid Specifications.
b.Each bidder shall bid in
his/her/their own name on
his/her/their behalf or in an official
capacity as an employee or owner of
a company. No bidder shall submit
more than one bid or have any in-
terest in more than one bid.
c.Only individuals intending to con-
duct operations under the retail
liquor license are invited to submit
bids.
d.A successful bidder may not
transfer this retail liquor license to
another person without first having
commenced operations for a period
of twelve (12) months or longer
under the license.
2.Bid Security of 10% of the bid
amount in the form of a certified
check or money order, payable to
the City of Minot;
a.The Bid Security shall be refunded
to unsuccessful bidders, but credited
towards the successful bidder’s pur-
chase price.
b.If the successful bidder voluntarily
rescinds their Bid, the Bid Security
shall be forfeited to the City.
3.A sworn application for a Retail
Liquor License, showing the bidder’s
qualifications and providing the infor-
mation listed in Minot City Ordinance
§ 5-18;
a.As required by 5-18(2), the appli-
cation shall include the street ad-
dress and legal description of the
premises sought to be licensed,
however, the floor plan of the prem-
ises to be licensed may be prelim-
inary in nature at the time of Bid
submission.
b.The successful bidder must submit
a final clear and understandable
floor plan per section 5-18(2), pass
all necessary premises inspections,
and begin operations within twelve
(12) months of being named the
successful bidder by the City Coun-
cil.
c.Failure to submit a final clear and
understandable floor plan, pass all
necessary premises inspections, or
begin operations within twelve (12)
months of being named the suc-
cessful bidder by the City Council
shall result in the license reverting to
the City.
4.A check in the amount of
$3,125.00 in the form of a certified
check or money order, payable to
the City of Minot to cover the annual
Retail Liquor License fee; and
a.The annual fee shall be refunded
to unsuccessful bidders, but credited
towards the successful bidder’s an-
nual Retail Liquor License fee.
5.A stamped return envelope.
a.This envelope will be used by the
City Clerk to return the Bidder’s Bid
Security and annual Retail Liquor
License fees in the event they are
not the high bid.
All bid envelopes must be sealed,
and have the following plainly
marked on the front of the envelope
containing the bid materials: RETAIL
LIQUOR LICENSE. Retail liquor
license applications are available at
the City Clerk’s Office or on the
City’s website. City of Minot’s Code
of Ordinances regarding alcoholic
beverages and licensing are acces-
sible through the City’s website:
https://www.minotnd.org/. City staff
will review and evaluate all bids for
completeness and compliance with
these Bid Specifications and the City
of Minot’s Code of Ordinances. Bids
that do not contain a complete copy
of all Bid Materials will be removed
from consideration. Bidders that do
not qualify for a license under the
City of Minot’s Code of Ordinances
will have their bid removed from
consideration. Following the award
of the retail liquor license(s), the City
Clerk will return checks submitted by
unsuccessful bidders in the return
envelopes submitted with their Bid.
The City Clerk shall submit a recom-
mendation for the bid award to the
City Council for its consideration
within forty-five days of the Bid
Opening. The successful bidder’s
application must be approved by the
City Council before the license may
be issued, except that a license may
be issued, contingent upon submis-
sion of a final clear and understand-
able floor plan per section 5-18(2),
passage of all necessary premises
inspections, and beginning opera-
tions within twelve (12) months of
being named the successful bidder
by the City Council. The City Coun-
cil will deposit the bid security and
annual license fee checks submitted
with the successful bid after the City
Council approves the award of the
Retail Liquor License. Upon the is-
suance of each license, the suc-
cessful bidder must pay the full
amount of the bid and any pro-rated
annual fee. If the successful bidder’s
checks are returned for
non-sufficient funds, the City Council
may offer the license to the next
highest bidder or, in the Council’s
sole discretion, decline to offer the
license to any remaining bidder. The
term of the retail liquor license is-
sued shall commence at the date
and time of its issuance by the City
Council, and shall expire at 11:59
p.m. on December 31, 2021. If the
initial term for the initial license is is-
sued for a term less than one year,
the City may pro-rate the annual fee
submitted with the successful bid
and apply additional license fees to-
wards next year’s license fee, but no
refund will be given if the license is
not used for the entire license term.
The City reserves the right to reject
any and all bids, to waive any infor-
malities in the bidding process or
any bid received, and to accept any
bid which, in sole judgment of the
City Council, is in the City’s best in-
terest. The Bid Form and Ordi-
nances relevant to this process are
attached to these instructions. If you
