Generally, the Work covered by the
Plans and Specifications for the 10th
Street N Improvements consists of
the materials, labor, tools, and
equipment required for topsoil strip-
ping, excavation and embankment
work, 2900 SY of Cement Stabilized
Subgrade, 1100 Ton of Aggregate
Base, 600 Ton of FAA 43 Super-
pave Hot Mix Asphalt, 100 SY 6″
Reinforced Concrete Pavement, 730
SY Concrete Sidewalk, Curb &
Gutter and other incidentals as iden-
tified in the Plans and Specifications.
A bid alternate will be available that
removes the Cement Stabilized
Subgrade and includes an additional
1100 Ton of Aggregate Base.
All Bids are to be submitted on the
basis of cash payment for the Work
and Materials, and are to be en-
closed in a sealed envelope ad-
dressed to the City of New Town,
PO Box 309, accompanied by a
separate envelope containing a
Bidder’s Bond in the sum equal to
5% of the full amount of the Bid, ex-
ecuted by the Bidder as Principal,
and by a Surety, conditioned that if
the Principal’s Bid is accepted and
the contract awarded to the Princi-
pal, the Principal, within ten days
after notice of award, shall execute a
Contract in accordance with the
terms of the Bid and Performance
and Payment Bonds as required by
the law and the regulation and deter-
minations of the Owner. If a suc-
cessful bidder does not execute a
contract within the ten days allowed,
the bidder’s bond must be forfeited
to the City of New Town and the pro-
ject will be awarded to the next
lowest responsible bidder. Bidder’s
shall be licensed for the full amount
of the Bid, as required by Sections
43-07-05 and 43-07-12 of the North
Dakota Century Code. A copy of the
Bidder’s Contractor’s License or
License Renewal must be included
in the Bid Bond envelope.
No Bid may be read or considered if
it does not fully comply with the re-
quirements of Section 48-01.2-05 of
the North Dakota Century Code.
Any deficient Bid received will be
resealed and returned to the Bidder
immediately.
The Owner reserves the right to hold
all Bids for 30 days, to reject any or
all Bids and to waive any informality
or irregularity in any Bid.
There shall be endorsed upon the
outside of the envelope containing
the Bid, the following:
1. “10th Street N Improvements”
2. The name of the person, firm, cor-
poration, or joint venture submitting
the Bid.
3. Acknowledgement of Addendum,
if any.
4. The Bidder’s Contractor’s License

Number.
The Work will be substantially com-
plete on or before August 27, 2021
and will be completed and ready for
final payment in accordance with
Paragraph 15.06 of the General
Conditions on or before October 1,
2021. If the work is not completed by
the times listed above the liquidated
damages will start and continue until
work is completed.

Generally, the Work covered by the
Plans and Specifications for the Gol-
dade Lift Station Replacement con-
sists of the materials, labor, tools,
and equipment required for the con-
struction a sanitary sewer lift station.
The Work includes the removal and
replacement of a sanitary sewer lift
station, two sanitary manholes, ap-
proximately 110 LF of gravity sani-
tary sewer, and approximately 65 LF
of sanitary sewer force main. The
Work shall also include the removal
and replacement of approximately
50 LF of curb & gutter, 35 SY of con-
crete sidewalk, 190 SY of asphalt
pavement, and other incidentals as
necessary to complete the project.
Details of the construction are in-
cluded in the Drawings and Project
Manual.
All Bids are to be submitted on the
basis of cash payment for the Work
and Materials necessary to complete
the project. Each bid must be ac-
companied by a separate envelope
containing the contractor’s license
and bid security. The bid security
must be in a sum equal to five per-
cent of the full amount of the bid and
must be in the form of a bidder’s
bond. A bidder’s bond must be exe-
cuted by the bidder as principal and
by a surety, conditioned that if the
principal’s bid is accepted and the
contract awarded to the principal,
the principal, within ten days after
notice of the award, shall execute a
contract in accordance with the
terms of the bid and the bid bond
and any condition of the governing
body. A countersignature of a bid
bond is not required under this sec-
tion. If a successful bidder does not
execute a contract within the ten
days allowed, the bidder’s bond
must be forfeited to the Owner and
the project awarded to the next
lowest responsible bidder. Bidders
must be licensed for the full amount
of the bid as required by section
43-07-12 of the North Dakota Centu-
ry Code.
Attention is called to the fact that
compliance with Community
Development Block Grant Disaster
Recovery (CDBG) federal labor
standards is required on this project
and will include Davis Bacon labor
rates, Section 3 employment plan,
not less than the minimum salaries
and wages as set forth in the Con-
tract Documents must be paid on
this project, and that the Contractor
must ensure that employees and ap-
plicants for employment are not
discriminated against because of
their race, color, religion, sex, or na-
tional origin.
No Bid may be read or considered if
it does not fully comply with the re-
quirements of Section 48-01.2-05 of
the North Dakota Century Code.
The Owner reserves the right to hold
all Bids for 60 days, to reject any or
all Bids, to waive any informality or
irregularity in any Bid, to accept the
Bid deemed in the best interest of
the Owner, and to rebid the project
until a satisfactory bid is received.

Should the Contractor fail to com-
plete its obligations under the Con-
tract within the time required herein
or within such extra time as may
have been granted by formal exten-
sions of time approved by the Own-
er, there will be deducted from any
amount due to the Contractor the
sum of $1,000 per day for each and
every calendar day that the comple-
tion of the Work is delayed. The
Contractor and his Surety will be li-
able for any excess. Such payment
will be as and for liquidated dam-
ages and not as a penalty.

The Parshall Municipal Airport Au-

reserves the right to hold all bids for
a period of 60 days after the date
fixed for the opening thereof to reject
any and all bids and waive defects
and to accept any bids should it be
deemed for the public good and also
reserves the right to reject the bid of
any party who has been delinquent
or unfaithful in the performance of

The successful Bidder will have to
obtain a statement from the Office of
the State Tax Commissioner show-

NOTICE OF REQUIREMENT FOR
AFFIRMATIVE ACTION to EN-
SURE EQUAL EMPLOYMENT OP-
PORTUNITY
1. The Offeror’s or Bidder’s attention
is called to the “Equal Opportunity
Clause” and the “Standard Federal
Equal Employment Opportunity
Construction Contract Specifica-
tions” set forth herein.
2. The goals and timetables for
minority and female participation,
expressed in percentage terms for
the Contractor’s aggregate work-
force in each trade on all construc-
tion work in the covered area, are as
follows:

These goals are applicable to all of
the Contractor’s construction work
(whether or not it is Federal or
federally assisted) performed in the
covered area. If the Contractor per-
forms construction work in a geo-
graphical area located outside of the
covered area, it shall apply the goals
established for such geographical
area where the work is actually per-
formed. With regard to this second
area, the Contractor also is subject
to the goals for both its federally in-
volved and non-federally involved
construction.
The Contractor’s compliance with
the Executive Order and the regula-
tions in 41 CFR Part 60-4 shall be
based on its implementation of the
Equal Opportunity Clause, specific
affirmative action obligations re-
quired by the specifications set forth
in 41 CFR 60-4.3(a) and its efforts to
meet the goals. The hours of minori-
ty and female employment and train-
ing must be substantially uniform
throughout the length of the contract,
and in each trade, and the Contrac-
tor shall make a good faith effort to
employ minorities and women even-
ly on each of its projects. The
transfer of minority or female em-
ployees or trainees from Contractor
to Contractor or from project to pro-
ject for the sole purpose of meeting
the Contractor’s goals shall be a vio-
lation of the contract, the Executive
Order and the regulations in 41 CFR
Part 60-4. Compliance with the
goals will be measured against the
total work hours performed.
3. The Contractor shall provide writ-
ten notification to the Director of the
Office of Federal Contract Compli-
ance Programs (OFCCP) within 10
working days of award of any con-
struction subcontract in excess of
$10,000 at any tier for construction
work under the contract resulting
from this solicitation. The notification
shall list the name, address, and
telephone number of the subcon-
tractor; employer identification
number of the subcontractor; es-
timated dollar amount of the subcon-
tract; estimated starting and comple-
tion dates of the subcontract; and
the geographical area in which the
subcontract is to be performed.
4. As used in this notice and in the
contract resulting from this solicita-
tion, the “covered area” is the State
of North Dakota, Mountrail County,
City of Parshall.
The Parshall Municipal Airport Au-
thority, in accordance with the provi-
sions of Title VI of the Civil Rights
Act of 1964 (78 Stat. 252, 42 U.S.C.
Section 2000d to 2000d-4) and the
Regulations, hereby notifies all
bidders or offerors that it will affirma-
tively ensure that any contract en-
tered into pursuant to this adver-

County Commission was called to
order by Chairman Fjeldahl at 9:00
AM with Commissioners, Anderson,

present. Also present were depart-
ment heads Bradley Starnes, Dana
Larsen, Emily Goff, Jason Blowers,
Jennifer Wiechmann, Kerrianne
Boetcher, Kristin Kowalczyk, Leona
Lochthowe, Marisa Haman, Melissa
Bliss, Noreen Barton, Robert Roed,
Roza Larson and Tammy Terras.

Jail Commander Major Paul Olthoff
appeared with an agreement
between Ward County and Trinity
Health to provide inmate health ser-
vices for Ward County Jail and Ju-
venile Health Services for Ward
County Juvenile Detention Center.

and sign the Agreement for Provid-
ing Inmate Health Service for Ward
County Jail and Juvenile Health Ser-

State’s Attorney Roza Larson ap-
peared with a request to spend
$8,200.00 from Asset Forfeiture
funds to bring an instructor to Minot
for multi-personnel disciplinary train-
ing for law enforcement and the at-
torneys in the State’s Attorney’s Of-
fice. The County Sheriff’s Depart-
ment, the Minot Police Department
and the Task Force will have per-
sonnel attend the training as will all
attorneys in her department.

Ms. Larson continued by informing
the Commission the medical exa-
miner has sent samples to private
labs for upcoming court cases. She

Director of Tax Equalization Noreen
Barton appeared with a memoran-
dum of tax roll adjustments for the
Commission approval. She re-
quested page 5 of the memorandum
be removed as the valuations are in-
correct and asked the Commission
to approve pages 1-4.

Planning and Zoning Administrator
Doug Diedrichsen appeared with a

Shane Soltis submitted a variance
application for the following
described property: 118 Rice Lake
Road S. Douglas, ND; Nesson’s plat
lot 18 and W 70′ of outlot 1 of lot 5;
section 10-152-85 Rice Lake. The
applicant is requesting a variance for
the side yard setback off the east
property line for a garage to be con-
structed. The owner is requesting to
build 7 feet from the property line
with a 13 feet setback requirement.

acres. Ward County zoning applies
with Kirkelie Township recommend-
ing approval. The proposed lots
meet the minimum zoning require-
ments for Ward County. Planning
Commission recommends approval
of the subdivision plat application
based on finding of facts and staff
recommendations.

ing applies with the township recom-
mendation pending. The proposed

brary being short funded in taxes.
She discussed a couple option with
the Commission to help resolve the
negative balance.

Chairman Fjeldahl requested Emer-
gency Management Director Jen-

COVID rapid antibody tests. The
tests are free from the state, but the
cost to process the test is estimated
at $21 per test.
A discussion was held regarding if
the County should continue with a
request to obtain tests from the
state. The County would pay Trinity
Health to process the tests using
funds received from the Cares Act.

fire Chiefs in the county and all are
on board with requesting the Res-
trictive Burn Ban.

Human Service Zone Director Melis-

an employee to this office and no

Board voted that Human Service
discontinues sending staff to the an-
cillary office.

discontinue servicing the Kenmare
Ancillary Office. Roll call; all voted

Highway Engineer Dana Larsen ap-
peared with three bids for the 2021
center and edge striping project. The
low bid of $196,338.32 was submit-
ted by J&J Striping.
Moved by Comm. Pietsch, second-
ed by Comm. Anderson to approve
the bid of $196,338.32 from J&J
Striping to complete the county wide
center edge line striping project. Roll

Human Resource Director Tammy
Terras gave the Commission an up-
date regarding the Building Inspec-
tor position. No proposals were sub-
mitted from outside contractors and
some applications have been re-
ceived and reviewed. She would like
authorization to proceed with inter-
viewing two of the candidates.

by Comm. Weppler to approve mov-
ing forward with interviewing candi-
dates for the Building Inspector posi-

Ms. Terras continued with a discus-
sion regarding the electronic time-

first steps and requested Commis-
sion direction to move forward with
the project.

brary bookmobile fund to make that
fund whole and work the library

The Commission moved the discus-

from Terry Traynor of NDACo re-
garding the relief bill signed by the
President. The bill allocated $130
billion for counties and cities. Ward
County is estimated to receive
$13,118,555. Comm. Weppler would

ing the funds for citizen tax relief and
other community needs.
