NOTICE IS HEREBY GIVEN that

the State of North Dakota, acting

through the State Water Commis-

sion, invites and will receive sealed

bids up to the hour of 1:30 P.M., lo-

cal time, on September 23, 2020, for

the furnishing to the State of North

Dakota of all transportation, labor,

materials, tools, equipment, ser-

vices, permits, utilities, and other

items necessary to construct said

work, in accordance with the draw-

ings and contract documents on file

in the office the North Dakota State

Water Commission. At said time,

said Bids will be publicly opened and

read aloud in the North Dakota State

Water Commission located at:

Bids shall conform to and be respon-

sive to the Contract Documents for

the work. The Contract Documents

will be available after August 21,

In accordance with the North Dakota

Century Code Chapter 48, the pro-

ject shall be comprised of multiple

Bids. There are five (5) Contracts:

Contract No. 1 – General Construc-

tion; Contract No. 2 – Mechanical

Construction; Contract No. 3 –

Electrical Construction; Contract No.

4 – Combined General, Mechanical,

and Electrical Construction, which

includes all Work for Contracts 1, 2,

and 3; and Contract No. 5 – 4.5 MG

Reservoir Construction. The

Contract(s) shall be awarded to the

lowest responsive bidder(s). The

sum of Contracts 1, 2, 3 will be com-

pared to Contract 4 to determine the

lowest bid. Either Contracts 1, 2, 3

and 5 will be awarded, or Contracts

4 and 5 will be awarded. The Gen-

eral Construction Contractor from

Contract 1 will assume responsibility

for coordinating the work of the

prime contractors responsible for

other contracts awarded. The scope

of Work for each Contract generally

consists of the following:

CONTRACT NO.1 – GENERAL

CONSTRUCTION

Construction work includes but is not

limited to: Site stripping, demolition

of existing 10-ft X 12-ft slab-on-

grade structure; construction of new

140-ft X 50-ft, concrete, steel, and

precast Booster Pump Station; mis-

cellaneous metalwork, doors, win-

dows, flooring, and coatings; and

other miscellaneous Work. Site pip-

ing in sizes ranging from 4-inch to

18-inch, site grading work outside of

the reservoir limits, site paving,

landscaping, and other miscellane-

ous Work.

CONTRACT NO.2 – MECHANICAL

CONSTRUCTION

Construction work includes but is not

limited to: Construction of new pro-

cess piping in sizes ranging from

1.25-inch to 18-inch, valves, actua-

tors, meters, supports, high service

and jockey pumps, surge tank sys-

tem, mechanical coatings, sump

pumps, plumbing, HVAC; and other

miscellaneous Work.

CONTRACT NO.3 – ELECTRICAL

CONSTRUCTION

Construction work includes but is not

limited to: Construction of new

PLC/PC based process control sys-

tems, control consoles, MCCs,

VFDs, starters, buried cable, general

building and process control electri-

cal Work; and other miscellaneous

Work.

CONTRACT NO.4 – COMBINED

GENERAL, MECHANICAL, &

ELECTRICAL CONSTRUCTION

Construction work includes: All work

associated with Contracts 1, 2, and

3 combined.

CONTRACT NO.5 – 4.5 MG

RESERVOIR CONSTRUCTION

Construction work includes: Con-

struction of new 4.5 MG Reservoir,

excavation and backfill for construc-

tion of reservoir, interior and over-

flow piping within reservoir, metal-

work, hatches, coatings; and other

miscellaneous Work.

The Contractor will not perform work

or permit the performance of Work

by subcontractors outside regular

dusk to dawn working hours or on

Saturdays, Sundays, or legal State

holidays without providing written

notice of proposed work to the En-

gineer a minimum of 5 days in ad-

vance and contingent on the

Owner’s written consent.

cations may be obtained following

receipt of payment of $750.00 per

set, non-refundable, or a CD may

be obtained with the documents in

electronic (pdf) format following re-

ceipt of payment of $40 per set,

In accordance with the current Ener-

gy and Water Development Ap-

propriations Act, to the greatest ex-

tent practical, all equipment and pro-

ducts purchased for use in this con-

tract shall be American-made.

A pre-Bid conference will be held on

at 10:00 a.m. on September 10,

2020 in the Conference Room at the

North Dakota State Water Commis-

sion Office located at 900 East

Boulevard Avenue, Bismarck, ND

58505. Representatives of Owner

and Engineer will be present to dis-

cuss the Project. Prospective prime

Bidders are required to attend and

participate in the conference.

Each bid shall be submitted on a

form furnished as part of the contract

documents and must be accom-

panied by a separate envelope

containing a Bidder’s Bond with

Acknowledgement of Surety in an

amount not less than 5% of the full

amount of the bid made payable to

the order of or for the benefit of the

North Dakota State Water Commis-

sion. The bid bond shall be executed

by the bidder as principal and by a

surety company authorized to do

business in the State of North Dako-

ta, conditioned that if the principal’s

Bid be accepted and the contract

awarded to the principal, within ten

(10) days after Notice of Award, the

Principal shall execute a contract in

accordance with the terms of the bid

and contractor’s performance and

payment bonds as required by law

and the regulations and determina-

tions of the North Dakota State Wa-

ter Commission. A bid submitted

without this information properly en-

closed in the bid bond envelope

shall not be read nor considered and

the envelope shall be resealed and

bid returned to the bidder immedi-

ately. Each bid shall be sealed and

delivered to the North Dakota State

Water Commission at the location

designated in this notice for the

opening of bids at or before the time

in this notice provided.

Unless a bidder obtains a

contractor’s license for the full

amount of its bid within twenty days

after it is determined the bidder is

the lowest responsive and responsi-

ble bidder, the bid must be rejected

and the contract awarded to the next

lowest, responsive, responsible, and

LICENSED bidder.

Substantial Completion for all

WORK shall be April 30, 2022. Fi-

nal Completion for all WORK

shall be June 15, 2022.

The State of North Dakota, acting

inate Ron Aberle for President. Mo-

tion by Wald to nominate Dustin

Mize for President. Voting was held

by paper ballot. By a vote of 3 to 2,

Ron Aberle is elected as President.

Mr. Aberle called for nominations for

Vice President. M/S/C Wald/Tyler to

nominate Dustin Mize for Vice

President. Roll call vote, Aberle-Y,

TUESDAY, AUGUST 4, 2020

President Ron Aberle called the spe-

cial meeting to order at 5:00 pm.

Board members present Ron Aberle,

Dustin Mize, Daniel Tyler, Nicole

Wald and Stephanie Munos. Also,

present Superintendent Gerding,

Principal Hansen and Business

Manager Twila Gantzer. The

2020-2021 Distance Learning Plan

was presented. Mrs Hansen

highlighted some of the key points.

Distance learning is always an op-

tion for any family. Changing

between distance learning and face

to face learning can only be done at

the end of the semester. Teachers

will be teaching in the classroom

and will live stream as well so that

each student is getting the same les-

son. M/S/C Munos/Mize to approve

the Distance Learning Plan. The

2020-2021 Health & Safety Smart

Restart Plan was presented. For

high school students Monday &

Thursday students will meet for

periods 1, 3, 5, & 7; Thursday & Fri-

day students will meet for periods 2,

4, 6 & 7. Wednesday will be dis-

tance learning. This is hybrid learn-

ing with block schedules. For high

school student’s attendance will not

be tied to semester tests. Transpor-

tation: All rural routes will run. Masks

will be required for all students.

Families will be seated together

when possible. Running in town

busses will not be an option be-

cause of the cleaning that must be

done between runs. At this time the

school will not be checking tempera-

tures. M/S/C Munos/Tyler to ap-

prove the Health & Safety Smart

Restart Plan. Nicole Wald would like

to see the school open at 7:45am for

parents who need to be to work by

8am. Mrs Hansen & Mr Gerding will

try to put together a plan for that. If

there is a positive test within the

school the school would shut down

for 48 hours. If 2 or more positive

cases occur, then the school would

close for 14 days. The school would

receive guidance from the First Dis-

trict Health Unit. If school is closed

down meals could be picked up at

the school, but the student would be

charged for the meals. For students

who are distance learning they too

have the option to pick up meals at

the school. 2020-2021 School

Calendar: Mr Gerding would like to

move the start date back to August

20th to allow a few extra days to

better prepare teachers for the

school year. Mr Gerding noted that

those days would not have to be

made up. M/S/C Munos/Tyler to ap-

prove the August 20th start date.

Special Education Teacher: Mrs

Hansen is recommending hiring

Shelby Gantzer for the special edu-

cation teacher. She has an elemen-

tary education degree and recently

passed her Praxis test which would

allow qualify her for the position. The

position was advertised on

NDEdJobs and the school website

with no applicants. Mrs Hansen also

contacted MSU & Souris Valley

Special Services. Mrs Wald ex-

pressed her concern about lack of

support in the position, no experi-

ence and feels like the school is set-

ting her up for failure. Mrs Hansen

stated that Shelby has enrolled in

her master’s program. Mr Tyler feels

like the school has resources avail-

able to help her succeed in the posi-

tion. M/S/C Tyler/Mize to approve

prove the June 24, 2020 special

meeting. Roll call vote, all yes. Audi-

ence: Akesha Juarez addressed the

board regarding the denial of an tui-

tion agreement for her child. She ex-

plained to the board that she pur-

chased a home in Surrey in 2019.

She was assured by Minot Public

that her child could remain in the

Minot Public school district. She is a

single parent and her child is on an

IEP. He has done well in the Minot

school district and she would hate to

disrupt his progress. M/S/C

Tyler/Mize to approve tuition agree-

ment # 57 out. Roll call vote, all yes.

Superintendent: Mr Gerding would

like to see a clause added to all

coaching contracts to protect the

school from having to pay out the

contract if the sport does not hap-

pen. M/S/C Wald/Mize to add “If for

any reason the extra circular activity

is not able to be held this coaching

contract will be void”. Mr Gerding

also discussed teacher negotiations.

Roll call vote, all yes. Negotiations

were done for a two-year period.

Just recently we were informed that

the school would not be receiving

the full dollar amount that was used

for the purpose of negotiations. Mr

Gerding would like to see a provi-

sion to re-open negotiations if the

funding from the state does not

come through. Mr Gerding shared

that currently we have about 5 fami-

lies with larger lunch bills. Mr Gerd-

ing would like to ask the board if a

letter can be sent letting parents

know that all outstanding bills must

be paid in full or students will not be

able to participate in sports. Mr

Gerding discussed the 20-21 budg-

et. The repayment of the loan is in-

cluded in the budget. Mr Gerding

was would like to see the special

reserve fund repayment made after

the bank loan is paid off to save in-

terest. Mrs Munos would like more

information regarding the custodial

staff salaries. Business Manager’s

Report: The financial reports were

presented. M/S/C Munos/Tyler to

approve financial reports as present-

ed and approve payment of July

payroll & benefits in the amount of $

102,309.23; July bills: General

Fund-$ 13,235.44; Activity Fund -$

44.00. Prepaid Check Register:

tuition agreement # 63 in. Roll call

New Business: Pre School: Current-

ly we are charging $150 per month

which equals $1,350 per year. Mr

Gerding would like to see that in-

creased to $200 per month. M/S/C

Mize/Tyler to increase the preschool

tuition for the 20-21 school year to

$200 per month and revisit the topic

at the next board meeting. Unfin-

ished Business: Exit Interviews:

Those did not take place and time

has passed and they will not be tak-

ing place. Blue Sox Contract: Mr

Aberle shared the signed contract

with the board. Audit Suggestions:

The administration is working on

putting some of these suggestions in

place. This item will stay on the

agenda. Special Ed Teacher: Mr

Gerding reported that there were no

applicants for the position. This per-

son will be a new hire. She will have

to take the praxis test and/or take

classes towards her master’s de-

gree. Mrs Munos expressed concern

regarding the stress of having a new

teacher in this position. Mr Aberle in-

formed the board that SRT is putting

fiber in Surrey. They will be running

a line to the crow’s nest & the con-

cession stand. He talked to CTI and

they will also be putting a drain in

the football field at no cost to the

school. Mr Aberle would like to see

an appreciation letter sent to them.

The next regular board meeting will

be Wednesday, August 12th at 5:00
