By MDN STAFF 1 min read

A Minot man has been sentenced to serve no less than two years for a February aggravated assault that resulted in serious bodily injury, a Class C felony.

Samuel Tyler Mauck Velasquez, 34, Minot, was sentenced to 10 years with the Department of Corrections and Rehabilitation and must serve three years, with a minimum mandatory sentence of two years and credit for 231 days served. He then will be on three years probation.

Mauck Velasquez was determined to be an habitual offender, having previously served time for gross sexual imposition and aggravated assault.

He also was fined $125 and ordered to have no contact with the victim.

According to the court affidavit, Mauck Velasquez was charged after police were called to an apartment building in response to a resident holding a board and threatening people. When police arrived, they found Mauck Velasquez standing over the resident on the ground. Mauck Velasquez stated the resident came at him with the board so he took it away and struck him in the head with it. After examining video footage supplied by another resident, police determined Mauck Velasquez had not engaged in self defense but in aggravated assault.
