A former Minot mayoral candidate is appealing the dismissal of one of two cases he filed against the city in 2025.
Josiah Roise, who is self represented, has two active lawsuits, both filed in April 2025, against the City of Minot related to April 2019 incidents involving the Minot Police Department. U.S. District Judge Daniel Hovland dismissed one lawsuit in July for failing to follow federal court procedures, and Roise filed an appeal to the 8th Circuit Court of Appeals on Aug. 19.
The complaint involves treatment deemed harassing by police, related to a traffic stop and to a police check of an open door at a local business at night. According to the court filing, police entered the business with guns drawn on suspicion of burglary after Roise, at the business owner’s invitation, had entered the building after hours with the owner.
Roise's second lawsuit that remains active was filed against the Minot Police Department and Ward County Sheriff’s Office, alleging violations of constitutional rights when pulled over by police and in a search of his parents' home in connection with an investigation into bomb-making by an employee of Roise's. The defendants have asked for dismissal.
Hovland also dismissed a lawsuit brought by Michael James Meyhoff, Kenmare, against three Minot police officers in connection to a February 2024 traffic stop in which a firearm was located. He stated in court records he was arrested for terrorizing another individual based on disputed statements and unlawfully obtained evidence. He was found not guilty in a July 2025 jury trial.
Meyhoff sought unspecified compensation for unlawful search and seizure and malicious prosecution. He recently filed a motion that argues judicial error and asks to vacate the dismissal and allow the case to proceed.
