A case involving attempted theft from Minot ATM machines has resulted in a 38-day sentence for Yohandri Ortega-Jiminez, 22, no fixed address, according to North Central District Court records.
Ortega-Jiminez pleaded guilty to attempted theft of $10,000-$50,000, a Class B felony.
He was arrested in June in connection with a series of ATM thefts by multiple individuals in the state, believed to be part of foreign terrorist organization. In the court affidavit, Ortega-Jiminez told investigators he was recruited by the organization in Colorado and was threatened when he sought to discontinue participation. He also admitted to involvement in Minot, Bismarck and Fargo ATM theft attempts.
He was sentenced to 10 years with the North Dakota Department of Corrections and Rehabilitation and ordered to serve 38 days. He received credit for the 38 days already served. He also will be on supervised probation for three years, pay fees of $775 and have no contact with First Western Bank & Trust and its branches for three years.
Charges of computer fraud, a Class C felony, and wearing a mask during commission of a criminal offense, a Class A misdemeanor, were dismissed.
