Christmas Eve shooting on track for October trial

The trial of the former Department of Homeland Security agent charged in the murder of serviceman Nicholas Van Pelt is still on track for its scheduled trial date in October following a scheduling conference in North Central District Court on Wednesday, June 10.
The purpose of the hearing was to take stock of the proceedings following a Supreme Court ruling on BEK TV’s requested supervisory writ, and the withdrawal of defendant Daniel Breijo’s attorney Jesse Walstad, along with the appointment of his replacement, public defender Steven Mottinger.
Among motions that District Judge Daniel El-Dweek still must rule on include instructions from the Supreme Court in its denial of BEK TV’s petition to quash a subpoena compelling it to provide un-aired interview footage and communications with the surviving victim. El-Dweek told the attorneys his orders regarding BEK TV’s motion and other pending issues are coming soon.
“We’ll keep things as they are for now then. You are both justifiably waiting for the court’s decision on that matter. We took quite a bit of testimony on one of those motions, and we’re still working through that. I’ll have a decision, hopefully, in short order on those matters,” El-Dweek said.
