Judge orders murder trial rescheduled

The trial of Daniel Breijo, the Surrey man charged in the Christmas Eve 2023 shooting death of Nicholas Van Pelt, has been postponed after a district court judge granted an order for a continuance.
Breijo’s attorney Jessey Walstad filed a motion earlier this month, seeking a continuance for the March 16 trial date, which identified a number of pending issues yet to be ruled on by the court involving critical evidentiary issues.
Walstad argued there wasn’t adequate time before trial to settle and review all of the potential evidence, nor was there a window to complete jury questionnaires to assist with jury selection given the media attention around the case.
According to court records, District Court Judge Daniel El-Dweek signed the order granting the motion to continue on Wednesday, Feb. 25.
A scheduling conference will be held Friday, Feb. 27, and an evidentiary hearing has been scheduled for Thursday, March 26.
