Tokio woman sentenced for fentanyl possession

A Tokio woman has been sentenced to serve 18 months after pleading guilty to possession of fentanyl with intent to distribute.

Hannah Shayleen Red Fox, 27, entered her change of plea on Friday, Oct. 31, in North Central District Court, pleading guilty to possession with intent manufacture/deliver-fentanyl, a Class B felony.

According to court documents, Red Fox was charged after the Ward County Narcotics Task Force executed a probation search on March 6 at a motel room in Minot. The probation search arose from a tip from another law enforcement officer who identified Red Fox and another man named Layton Lawrence Duchaine, 31, as possibly staying in the hotel. At the time both Red Fox and Duchaine had several warrants out for their arrests.

Task force officers entered the room and detained Duchaine, Red Fox and two others. All of those detained were on probation in North Dakota according to court documents and were not actively reporting to their assigned probation officers.

According to the affidavit of probable cause, a variety of drug distribution paraphernalia such as scales and narcotics paraphernalia were located in the room, including notebooks containing pay/owe sheets with names and dollar amounts.

During initial booking at the Ward County Jail, about 1 gram of suspected fentanyl and two blue pills were located on Red Fox’s person, according to the affidavit of probable cause.

Judge Richard Hagar sentenced Red Fox to serve 10 years with the Department of Corrections and Rehabilitation, with all but 18 months suspended pending her completion of three years of supervised probation upon release. She was also given credit for 229 days already served and assessed $775 in court fines and fees.
