Second man sentenced in overdose death

A Minot man was sentenced, Friday, Nov. 14, to serve five years in state prison after pleading guilty to distributing narcotics which resulted in the overdose death of another man in May.

Jarrin Jay Brady, 40, entered a change of plea in North Central District Court, pleading guilty to one Class A felony count of distribution of controlled substance-resulting in death or injury. Brady’s change of plea came just days after codefendant Calvin Brien, 26, Minot pleaded guilty to the same Class A felony and delivery of a controlled substance-fentanyl, a Class B felony.

According to court documents, Minot police were called to a residence on May 2 after receiving a report of a young man being found dead from an apparent fentanyl overdose. A review of the victim’s cell phone located deleted messages discussing narcotics purchases with Brien. Additional messages showed the victim paid Brien through a payment app, who then paid another man identified as Brady for fentanyl powder, according to the affidavit of probable cause.

Judge Richard Hagar sentenced Brady to serve 18 months with the Department of Corrections and Rehabilitation, with all but five years suspended pending the completion of three years of supervised probation. Brady was given credit for 161 days already served, and was ordered to have no contact with the family of the victim. He was also assessed $1,025 in court fines and fees.

Starting at $2.99/week.
