Minot man sentenced in overdose death
A Minot man has been sentenced to eight years with the Department of Corrections and Rehabilitation after pleading guilty to his role in the overdose and death of another man in May.
Calvin James Blaine Brien, 26, entered a change of plea in North Central District Court on Thursday, Nov. 6, pleading guilty to distribution of a controlled substance-resulting in death or injury, a Class A felony; delivery of controlled substance-fentanyl, a Class B felony. Two additional counts of delivery of a controlled substance were dismissed in accordance with a plea agreement.
According to court documents, Minot police were called to a residence on May 2 after receiving a report of a young man being found dead from apparent fentanyl overdose. A review of the victim’s cell phone located deleted messages with Brien, discussing the purchase of narcotics. According to the affidavit of probable cause, additional messages showed the victim paid Brien through a payment app, which then paid another man identified as Jarrin Brady, 40, Minot, for fentanyl powder.
District Court Judge Richard Hagar sentenced Brien to serve 18 years with the Department of Corrections and Rehabilitation, with 10 years suspended pending the completion of three years of supervised probation upon release. Brien was ordered to have no contact with the victim’s family, and to pay $1,025 in court fines and fees.
Brady was charged with one count of distribution of controlled substance-resulting in death or injury, a Class felony. He is scheduled to a jury trial commencing on Dec. 2.
