Suspended sentence imposed for narcotics
A Parshall woman received a suspended sentence after entering a guilty plea to fentanyl possession with intent to distribute.
Maelee Carlyl Heart, 24, entered a change of plea in North Central District Court on Aug. 20, pleading guilty to possession of fentanyl with intent to distribute, a Class B felony, and unlawful possession of drug paraphernalia, a Class C felony.
According to court documents, Heart was charged following the traffic stop of a vehicle in which she was a passenger. The vehicle was seen leaving a southeast Ward County address known by the Ward County Sheriff’s Department to house numerous people with active warrants. Heart was the registered owner of the vehicle, and a search of the vehicle located a small vial containing liquid methamphetamine, paraphernalia, $1,050 in cash and one M30 fentanyl pill.
Heart was transported to the Ward County Jail, where a subsequent search of her person located 15 additional M30 fentanyl pills and about 3 grams of pure powder fentanyl. According to the affidavit of probable cause, the amount of fentanyl located in her possession was enough to dose more than 40 people.
District Judge Gary Lee sentenced Heart to 10 years with the Department of Corrections and Rehabilitation, with all but 30 days suspended pending the completion of three years of supervised probation. Heart was given credit for 30 days already served and ordered to complete a chemical dependency evaluation. She also was assessed $875 in court fines and fees.
