Minot man charged after incident with BB gun

A Minot man was arrested and charged with shooting another person multiple times in the face with a BB gun in Devils Lake on Sunday, Aug. 10.

Tobias McKay, 25, Minot, has been charged in Northeast District Court with aggravated assault-dangerous weapon, terrorizing-adult victim, and reckless endangerment-extreme indifference, all Class C felonies.

Based on the complaint filed with the court, law enforcement was dispatched in the late evening on Sunday to Railroad Avenue and Fourth Avenue Northeast in Devils Lake for a report of a shooting. Officers met with the victim and an eyewitness. The victim was bleeding from the mouth and reported had been shot multiple times with a BB gun in the face which may have resulted in losing teeth. The victim was treated for injuries and transported to a hospital.

The eyewitness stated seeing a man arrive at the address who began punching the victim in the face before he pulled out a black pistol and fired it into the victim’s face multiple times. The witness recorded the incident with a phone, and the eyewitness believed the BB gun was real.

The suspect was eventually located at the Spirit Lake Inn and identified as McKay based on the description provided by the victim and eyewitness. The BB gun was located in McKay’s room.

McKay is scheduled to appear for an initial appearance on Monday, Aug. 25, in Devils Lake.
