Minot woman receives three-year sentence for federal charges
A Minot woman has been sentenced to three years in state prison after pleading guilty to two narcotics related felonies in two separate cases.
Hope Marie Burd, 38, Minot, entered a change of plea in both cases in North Central District Court on July 17, pleading guilty to one count of delivery of a controlled substance-methamphetamine and one count of possession of methamphetamine with intent to deliver, both Class B felonies.
Four class C felony counts of unlawful possession of drug paraphernalia, possession of a schedule IV depressant, possession of methamphetamine, prohibited acts B, and one Class B misdemeanor count of driving under suspension were dismissed in accordance with a plea agreement.
According to court documents, the possession with intent to distribute-methamphetamine charge stemmed from a traffic stop initiated by a Ward County Narcotics Task Force officer in September 2024. A K9 officer arrived at the location, and the K9 gave a positive alert on the vehicle for the presence of narcotics. A search of the vehicle located methamphetamine, methamphetamine after product and narcotic distribution paraphernalia.
Officers requested a probation search of Burd’s phone, and identified about six different conversations related to the sale of narcotics.
According to the declaration of probable cause in the second case, Task Force officers, conducting surveillance on Burd’s apartment in southwest Minot on May 5, observed a man identified as Justin Marshall Rostad, 32, Minot, enter the apartment and leave shortly after. A traffic stop was initiated on Rostad’s vehicle, he was arrested on an outstanding warrant and methamphetamine was located on him.
The task force executed a search warrant on Burd’s apartment on May 7, which located drug distribution paraphernalia, Schedule IV alprazolam and other items. Burd told officers she was holding the methamphetamine at her apartment for Rostad, and that she gave it back to him.
District Judge Richard Hagar sentenced Burd to a concurrent sentence of 10 years with the Department of Corrections and Rehabilitation with seven years suspended pending her completion of three years of supervised probation. Burd was given credit for 116 days already served, and ordered to complete a chemical dependency evaluation.
Hagar recommended Burd be considered for placement at the Tompkins Rehabilitation and Corrections Center in Jamestown at a time deemed appropriate by corrections personnel. Burd was also assessed $2,700 in court fines and fees.
Rostad was charged with one Class C felony count of possession of controlled substance-methamphetamine-second offense, and is scheduled to appear for a preliminary hearing on Thursday, July 24.
