Woman receives 6 years in prison for sexual communications with minor

A Minot woman charged with sexual communications with a minor has been sentenced to six years in state prison after entering into a plea agreement with state prosecutors.

Halena Amber Boothe, 52, Minot, appeared in North Central District Court on Friday for her sentencing, after entering an open plea of guilty to two counts of use of a minor in a sexual performance, a Class A felony; and possession of certain materials prohibited, a Class C felony. Two additional counts of promoting a sexual performance of a minor, a Class B felony, and luring minors by computer-believes victim 15-17, a Class C felony, were dismissed in accordance with the plea agreement.

According to court documents, Boothe was charged after a parent of the victim reported sexually explicit communications between Boothe and the victim. These communications were forensically extracted from Boothe’s phone.

Ward County State’s Attorney Roza Larson had recommended a sentence of 10 years with the Department of Corrections and Rehabilitation for the first count, with five suspended, and a concurrent sentence of five years for the second. As Boothe’s plea was entered on an open basis, Judge Douglas Mattson was not bound to follow Larson’s sentencing recommendation.

Mattson sentenced Boothe to serve six of the 10 years for the Class A felony and five years for the possession charge, with credit for 64 days served. Boothe will be required to register as a sex offender, have no contact with the victim and complete five years of supervised probation upon release.
