Ross man pleads guilty to felony DUI, sentenced

A Ross man has pleaded guilty to felony driving under the influence in North Central District Court.

Travis Jon Barstad, 42, was charged with DUI-.08 or greater-fourth or subsequent offense in 15 years, a Class C felony.

According to court documents, on May 8, 2014, at about 6 p.m., Barstad was arrested for DUI and driving under suspension. The officer had received a call about a possible drunk driver in Stanley and located the vehicle, observing it cross the fog lines several times, according to the affidavit of probable cause. The officer activated his emergency lights and Barstad took about a half a mile to react and stop. Barstad declined a field sobriety test but agreed to a breath-alcohol test, which found his alcohol level at .28. The officer also noticed that Barstad had a suspended license from out of state.

Barstad’s passenger, Levi Wolf, admitted to officers the pair had been drinking at a bar, and while speaking with Wolf, the officer noticed several open beer cans on the passenger side, which Wolf claimed as his.

Barstad was transported to the Mountrail County Correctional Center, where he took a chemical breath test, which was above the legal limit for operating a vehicle.

Barstad was sentenced in Mountrail County by Judge Todd Cresap to three years confinement, to first serve 10 days, and three years supervised probation. He must also complete a 24/7 sobriety program and a chemical dependency evaluation, as well as pay fines and fees of $2,525.
