Minot man found guilty of manslaughter

A Minot man who was charged with murder for 2023 bar shooting in Beulah was found guilty of manslaughter by a Mercer County jury after a trial concluded on Thursday.

The charges against Shawn Gramkow, 38, Minot, stemmed from a March 30, 2023, incident at Fanatics Bar in Beulah.

According to court documents, a fight broke out between Gramkow and two other individuals after he allegedly made a racist comment. Surveillance video showed Gramkow pulled a handgun from his waistband and fired a total of 10 shots, wounding one of the men and killing the other, who was identified as Phillip Luster.

Gramkow fled the scene but was stopped and detained south of the bar by a Beulah Police officer.

Gramkow was initially charged with murder and attempted murder, both Class A felonies; aggravated assault-dangerous weapon and reckless endangerment-extreme indifference-dangerous weapon, both Class C felonies; and DUI-.08% or greater-first offense, a Class B misdemeanor. Gramkow pleaded guilty to the DUI charge at a hearing in June, and the attempted murder charge was dismissed.

Gramkow’s trial began on Sept. 11, and the jury was sent to deliberate after testimony concluded on Sept. 12. The jury found Gramkow not guilty on the murder charge and entered a guilty verdict for the lesser included charge of manslaughter. Gramkow was acquitted by the jury for the count of aggravated assault but found guilty for the count of reckless endangerment.

District Court Judge Cynthia Feland has ordered a presentence investigation but no sentencing date has been set. Manslaughter is a Class B felony and Grankow faces up to 10 years with the Department of Corrections and/or a fine of $20,000. The Class C felony carries a maximum sentence of five years and $5,000 in fines.
